ന്യൂഡല്‍ഹി: ശബരിമല യുവതീ പ്രവേശവുമായി ബന്ധപ്പെട്ട പുനഃപരിശോധനാ ഹര്‍ജികള്‍ പരിഗണിക്കുന്നതിനായി സുപ്രീം കോടതി ചീഫ് ജസ്റ്റിസ് സൂര്യകാന്തിന്റെ നേതൃത്വത്തില്‍ ഒമ്പതംഗ ഭരണഘടനാ ബെഞ്ച് ഔദ്യോഗികമായി രൂപീകരിച്ചു. ഏപ്രില്‍ 7 മുതലാണ് വാദം ആരംഭിക്കുന്നത്.

ചീഫ് ജസ്റ്റിസ് അധ്യക്ഷനായ ബെഞ്ചില്‍ സുപ്രീം കോടതിയിലെ പ്രമുഖരായ എട്ട് ന്യായാധിപന്മാര്‍ കൂടി ഉള്‍പ്പെടുന്നു. ബെഞ്ചിലെ ഏക വനിതാ അംഗം ജസ്റ്റിസ് ബി.വി. നാഗരത്നയാണ്.

ശബരിമല കേസ് മാത്രമായിരിക്കില്ല ഈ ബെഞ്ച് പരിഗണിക്കുന്നത്. മറിച്ച്, മതപരമായ ആചാരങ്ങളും വ്യക്തിസ്വാതന്ത്ര്യവും തമ്മിലുള്ള തര്‍ക്കങ്ങളില്‍ കോടതിക്ക് എത്രത്തോളം ഇടപെടാം എന്നതിനെക്കുറിച്ചുള്ള ഏഴ് പ്രധാന ഭരണഘടനാ ചോദ്യങ്ങളാണ് ഈ ബെഞ്ച് പരിശോധിക്കുക:

ഭരണഘടനയുടെ 25, 26 അനുച്ഛേദങ്ങള്‍ ഉറപ്പുനല്‍കുന്ന മതസ്വാതന്ത്ര്യം.

'ഭരണഘടനാപരമായ സദാചാരം'എന്ന പദത്തിന്റെ വ്യാപ്തി.

ഒരു മതത്തിലെ 'അത്യാവശ്യ ആചാരങ്ങള്‍' എന്താണെന്ന് തീരുമാനിക്കാനുള്ള കോടതിയുടെ അധികാരം.

ഒരു മതവിഭാഗത്തിലെ ആചാരത്തെ ആ വിഭാഗത്തില്‍പ്പെടാത്ത ഒരാള്‍ക്ക് ചോദ്യം ചെയ്യാന്‍ സാധിക്കുമോ എന്നത്.

കേരള സര്‍ക്കാരിന്റെ പുതിയ നിലപാട്

സംസ്ഥാന സര്‍ക്കാരിന്റെ നിലപാടില്‍ വന്ന മാറ്റം ഏറെ ശ്രദ്ധേയമാണ്. മുമ്പ് യുവതീ പ്രവേശത്തെ ശക്തമായി പിന്തുണച്ചിരുന്ന എല്‍.ഡി.എഫ് സര്‍ക്കാര്‍, ഇപ്പോള്‍ കളം മാറിയിരിക്കുകയാണ്. ആചാരങ്ങളില്‍ മാറ്റം വരുത്തുന്നതിന് മുന്‍പ് മതപണ്ഡിതന്മാര്‍, സാമൂഹിക പരിഷ്‌കര്‍ത്താക്കള്‍ എന്നിവരടങ്ങുന്ന ഒരു സമിതി രൂപീകരിച്ച് അവരുടെ അഭിപ്രായം തേടണമെന്ന് സര്‍ക്കാര്‍ കോടതിയെ അറിയിച്ചു.

ഭക്തരുടെ വികാരങ്ങളും വിശ്വാസങ്ങളും കണക്കിലെടുത്ത് വിപുലമായ ചര്‍ച്ചകള്‍ക്ക് ശേഷമേ തീരുമാനമെടുക്കാവൂ എന്നാണ് സര്‍ക്കാരിന്റെ പുതിയ സത്യവാങ്മൂലത്തിന്റെ ചുരുക്കം. ഏപ്രില്‍ 7-ന് ആരംഭിക്കുന്ന വാദം ഏപ്രില്‍ 22ന് പൂര്‍ത്തിയാക്കാനാണ് കോടതി ലക്ഷ്യമിടുന്നത്. ഈ കേസിന്റെ വിധി ശബരിമലയില്‍ മാത്രമല്ല, മുസ്ലിം പള്ളികളിലെ സ്ത്രീ പ്രവേശം, പാഴ്‌സി സ്ത്രീകളുടെ അവകാശങ്ങള്‍ തുടങ്ങിയ സമാനമായ മറ്റ് കേസുകളിലും നിര്‍ണ്ണായകമാകും.

This bench will not be examining the Sabarimala case in isolation. Instead, it will deliberate on seven key constitutional questions regarding the extent of judicial intervention in conflicts between religious practices and individual liberty:

Religious freedom guaranteed under Articles 25 and 26 of the Constitution.

The scope of the term "Constitutional Morality."

The court's authority to decide what constitutes "essential religious practices."

Whether a person outside a specific religious denomination can challenge its internal practices.

The shift in the State Government’s position is particularly noteworthy. The LDF government, which previously championed the entry of women, has now changed its stance. The government informed the court that before altering long-standing traditions, a committee comprising religious scholars and social reformers should be formed to seek their expertise.

The gist of the government's new affidavit is that a decision should only be made after extensive discussions, taking into account the sentiments and beliefs of devotees.

The court aims to conclude the arguments, beginning April 7, by April 22. The verdict in this case will be decisive not only for Sabarimala but also for similar legal battles, such as the entry of women into mosques and the rights of Parsi women.
