ന്യൂഡല്‍ഹി: ഭര്‍ത്താവ് ഭാര്യയ്ക്ക് മേല്‍ നടത്തുന്ന നിര്‍ബന്ധിത പ്രകൃതിവിരുദ്ധ ലൈംഗികത ഇന്ത്യന്‍ ശിക്ഷാനിയമത്തിലെ സെക്ഷന്‍ 498അ പ്രകാരം 'ക്രൂരത'യുടെ പരിധിയില്‍ വരുമെന്നും, എന്നാല്‍ സെക്ഷന്‍ 375-ലെ നിയമപരമായ സവിശേഷ ഒഴിവാക്കല്‍ നിലനില്‍ക്കുന്നതിനാല്‍ ഇതിനെ സെക്ഷന്‍ 376 പ്രകാരം ബലാത്സംഗമായി കണക്കാക്കാന്‍ കഴിയില്ലെന്നും മധ്യപ്രദേശ് ഹൈക്കോടതി വിധിച്ചു.

ഐപിസി സെക്ഷന്‍ 498എ, 376(2)(ി), 377, 323, 294 എന്നീ വകുപ്പുകള്‍ പ്രകാരം രജിസ്റ്റര്‍ ചെയ്ത എഫ്.ഐ.ആര്‍, കുറ്റപത്രം, മജിസ്ട്രേറ്റ് കോടതിയുടെ നടപടികള്‍ എന്നിവ റദ്ദാക്കണമെന്ന് ആവശ്യപ്പെട്ട് സമര്‍പ്പിച്ച ഹര്‍ജി പരിഗണിക്കുകയായിരുന്നു കോടതി. ജസ്റ്റിസ് രാജേഷ് കുമാര്‍ ഗുപ്ത അധ്യക്ഷനായ ബെഞ്ചാണ് ഈ വിധി പുറപ്പെടുവിച്ചത്.

ഹര്‍ജിക്കാരനായ ഭര്‍ത്താവും രണ്ടാം എതിര്‍കക്ഷിയായ യുവതിയും 2022 ജൂണിലാണ് വിവാഹിതരായത്. വിവാഹത്തിന് പിന്നാലെ ഇവര്‍ക്കിടയില്‍ തര്‍ക്കങ്ങള്‍ ഉണ്ടാവുകയും ശാരീരിക പീഡന ആരോപണങ്ങള്‍ ഉയരുകയും ചെയ്തു. ഭര്‍ത്താവ് തന്റെ സമ്മതമില്ലാതെ പ്രകൃതിവിരുദ്ധ ലൈംഗിക കൃത്യങ്ങളില്‍ ഏര്‍പ്പെട്ടതായും ശാരീരികമായി പീഡിപ്പിച്ചതായും ഭാര്യ പരാതി നല്‍കി. ഇതിന്റെ അടിസ്ഥാനത്തില്‍ പോലീസ് കേസെടുക്കുകയും കുറ്റപത്രം സമര്‍പ്പിക്കുകയും ചെയ്തു. എന്നാല്‍, വിവാഹബന്ധം നിലനില്‍ക്കുന്നതിനാല്‍ ബലാത്സംഗ കുറ്റം നിലനില്‍ക്കില്ലെന്നും വിവാഹമോചനക്കേസിന് പ്രതികാരമായാണ് ഈ പരാതി നല്‍കിയതെന്നും ഭര്‍ത്താവ് കോടതിയില്‍ വാദിച്ചു.

കോടതിയുടെ നിരീക്ഷണങ്ങള്‍

18 വയസ്സിന് മുകളിലുള്ള ഭാര്യയുമായി ഒരു പുരുഷന്‍ നടത്തുന്ന ലൈംഗിക കൃത്യങ്ങള്‍ ബലാത്സംഗമല്ല. അതിനാല്‍, സെക്ഷന്‍ 376 പ്രകാരം ഭര്‍ത്താവിനെ ശിക്ഷിക്കാന്‍ കഴിയില്ല. സുപ്രീം കോടതിയുടെ കുല്‍ദീപ് സിംഗ് ്. സ്റ്റേറ്റ് ഒഫ് പഞ്ചാബ് എന്ന വിധി ചൂണ്ടിക്കാട്ടി കോടതി പറഞ്ഞു.

നവ്തേജ് സിംഗ് ജോഹര്‍ ്. യൂണിയന്‍ ഒഫ് ഇന്ത്യ എന്ന വിധി പ്രകാരം പ്രായപൂര്‍ത്തിയായവര്‍ തമ്മിലുള്ള സമ്മതത്തോടെയുള്ള പ്രകൃതിവിരുദ്ധ ലൈംഗികത കുറ്റകരമല്ല. ഒരു വിവാഹബന്ധത്തില്‍, സെക്ഷന്‍ 375 പ്രകാരം സംരക്ഷണം ലഭിക്കുന്ന ഒരു പ്രവൃത്തിയില്‍ സെക്ഷന്‍ 377 ചുമത്തുന്നത് നിയമപരമായ വൈരുദ്ധ്യത്തിന് കാരണമാകുമെന്ന് കോടതി ചൂണ്ടിക്കാട്ടി.

ലൈംഗിക അതിക്രമത്തിന് ബലാത്സംഗ കുറ്റം ചുമത്താന്‍ കഴിയില്ലെങ്കിലും, അത്തരം പ്രവൃത്തികള്‍ സെക്ഷന്‍ 498എ പ്രകാരം 'ക്രൂരത'യായി കണക്കാക്കാം. ക്രൂരത എന്നത് വെറും സ്ത്രീധന പീഡനത്തില്‍ മാത്രം ഒതുങ്ങുന്നതല്ലെന്നും അത് ശാരീരികമോ മാനസികമോ ആയ ഗുരുതരമായ ദ്രോഹങ്ങളെ ഉള്‍ക്കൊള്ളുന്നതാണെന്നും കോടതി വ്യക്തമാക്കി.

പ്രകൃതിവിരുദ്ധ ലൈംഗികത നടന്നതായി ശരിവെക്കുന്ന മെഡിക്കല്‍ തെളിവുകള്‍ അന്വേഷണത്തില്‍ ലഭിച്ചിട്ടില്ലെന്നും കോടതി നിരീക്ഷിച്ചു.

ഹര്‍ജി ഭാഗികമായി അനുവദിച്ച ഹൈക്കോടതി, ഹര്‍ജിക്കാരനെതിരെ ചുമത്തിയിരുന്ന സെക്ഷന്‍ 376(2)(ി), 377 എന്നീ വകുപ്പുകള്‍ റദ്ദാക്കി. എന്നാല്‍, സെക്ഷന്‍ 498എ (ക്രൂരത), 323 (പരിക്കേല്‍പ്പിക്കല്‍), 294 (അസഭ്യം പറയല്‍) എന്നീ വകുപ്പുകള്‍ നിലനിര്‍ത്തി. ഇവ വസ്തുതാപരമായ കാര്യങ്ങളായതിനാല്‍ വിചാരണയിലൂടെ മാത്രമേ തീരുമാനിക്കാന്‍ കഴിയൂ എന്ന് കോടതി വ്യക്തമാക്കി.

Observations of the Court

Marital Rape Exception: Sexual acts by a man with his wife, provided she is above 18 years of age, do not constitute rape. Therefore, a husband cannot be punished under Section 376. The court cited the Supreme Court judgment in Kuldeep Singh v. State of Punjab to support this.

Section 377 vs Section 375: Referring to the Navtej Singh Johar v. Union of India verdict, the court noted that consensual unnatural sex between adults is not a crime. The court pointed out that invoking Section 377 for an act protected under Section 375 within a marriage would lead to a legal contradiction (repugnancy).

Scope of Cruelty (Section 498A): Although a rape charge cannot be framed for sexual violence within marriage, such acts can be considered 'Cruelty' under Section 498A. The court clarified that cruelty is not limited to dowry harassment but includes any act that causes serious physical or mental harm.

Lack of Evidence: The court also observed that medical evidence confirming the occurrence of unnatural sex was not obtained during the investigation.

Conclusion

Partially allowing the petition, the High Court quashed the charges under Sections 376(2)(n) and 377 against the petitioner. However, the court maintained the charges under Sections 498A (Cruelty), 323 (Voluntarily causing hurt), and 294 (Obscene acts). The court stated that these are factual matters that can only be decided through a trial.
