അടിവസ്ത്ര കേസില്‍ ആന്റണി രാജുവിന് മൂന്നു വര്‍ഷം കഠിന തടവ്, സ്‌റ്റേ ലഭിച്ചില്ലെങ്കില്‍ എം എല്‍ എ സ്ഥാനം പോകും, മത്സരിക്കാനുമാവില്ല

തിരുവനന്തപുരം : തൊണ്ടിമുതല്‍ കേസില്‍ 32 വര്‍ഷം നീണ്ട നിയമപോരാട്ടത്തിനൊടുവില്‍ മുന്‍ മന്ത്രിയും എംഎല്‍എയുമായ ആന്റണി രാജുവിന് നെടുമങ്ങാട് ജുഡിഷ്യല്‍ ഫസ്റ്റ് ക്ലാസ് മജിസ്ട്രേറ്റ് കോടതി മൂന്നു വര്‍ഷം കഠിനതടവും പിഴയും ശിക്ഷ വിധിച്ചു. കേസില്‍ ആന്റണി രാജു രണ്ടാം പ്രതിയാണ്. രണ്ട് വര്‍ഷത്തിന് മുകളില്‍ തടവ് ശിക്ഷ ലഭിച്ചതോടെ ജനപ്രതിനിധി സ്ഥാനത്തിനും അയോഗ്യത വരും.

ഒന്നാം പ്രതിയായ കോടതി മുന്‍ ബെഞ്ച് ക്ലര്‍ക്ക് കെ.എസ്. ജോസും കുറ്റക്കാരാണെന്ന് കോടതി വിധിച്ചു. തെളിവ് നശിപ്പിക്കല്‍, ഗൂഢാലോചന, ഔദ്യോഗിക രേഖകളില്‍ തിരിമറി നടത്തല്‍ തുടങ്ങിയ കുറ്റങ്ങളാണ് തെളിയിക്കപ്പെട്ടത്.

1990-ല്‍ തിരുവനന്തപുരം വിമാനത്താവളത്തില്‍ വച്ച് ഓസ്ട്രേലിയന്‍ പൗരനായ ആന്‍ഡ്രൂ സാല്‍വത്തോര്‍ സെര്‍വെല്ലി ലഹരിമരുന്നുമായി പിടിയിലായി. അടിവസ്ത്രത്തില്‍ ഒളിപ്പിച്ച നിലയിലായിരുന്നു ചരസ് കണ്ടെത്തിയത്.

ഈ കേസില്‍ പ്രതിയുടെ അഭിഭാഷകനായിരുന്നു ആന്റണി രാജു. കോടതിയുടെ കസ്റ്റഡിയിലിരുന്ന തൊണ്ടിമുതലായ അടിവസ്ത്രം, ആന്റണി രാജുവും കോടതി ജീവനക്കാരനായ ജോസും ചേര്‍ന്ന് പുറത്തെടുക്കുകയും അത് വെട്ടിത്തയ്ച്ച് ചെറുതാക്കി തിരികെ വക്കുകയും ചെയ്തു എന്നാണ് കേസ്.

ഇതോടെ, കേസ് ഹൈക്കോടതിയില്‍ എത്തിയപ്പോള്‍, ഈ അടിവസ്ത്രം പ്രതിക്ക് പാകമാകില്ലെന്ന് വാദിക്കുകയും കോടതി അത് ശരിവച്ച് പ്രതിയെ വിട്ടയക്കുകയും ചെയ്തു.

ശിക്ഷയില്‍ നിന്ന് രക്ഷപ്പെട്ട് നാട്ടിലെത്തിയ പ്രതി മറ്റൊരു കേസില്‍ അവിടെ ജയിലിലായപ്പോള്‍, കേരളത്തില്‍ താന്‍ രക്ഷപ്പെട്ടത് തൊണ്ടിമുതല്‍ മാറ്റിയിട്ടാണെന്ന് സഹതടവുകാരനോട് വെളിപ്പെടുത്തി. ഇതാണ് കേസിന് വഴിത്തിരിവായത്.

തുടര്‍ന്ന് 1994-ലാണ് ആന്റണി രാജുവിനെതിരെ കേസെടുത്തത്.

വിധിക്ക് പിന്നാലെ മേല്‍ക്കോടതിയെ സമീപിക്കുമെന്ന് ആന്റണി രാജു അറിയിച്ചിട്ടുണ്ട്. വിധി വന്നതോടെ ആന്റണി രാജു എംഎല്‍എ സ്ഥാനം രാജിവെക്കണമെന്ന ആവശ്യം ശക്തമായിരിക്കുകയാണ്. എല്‍ഡിഎഫ് മുന്നണിയിലും ഇത് വലിയ ചര്‍ച്ചകള്‍ക്ക് വഴിവക്കും. ശിക്ഷയ്ക്കു സ്‌റ്റേ ലഭിച്ചാല്‍ രാജി ഒഴിവാക്കാം. സ്‌റ്റേ ലഭിച്ചില്ലെങ്കില്‍ വരുന്ന തിരഞ്ഞെടുപ്പില്‍ ആന്റണി രാജുവിന് മത്സരിക്കാനുമാവില്ല.

സുപ്രീം കോടതിയുടെ ഉത്തരവ് പ്രകാരം, രണ്ട് വര്‍ഷത്തിന് മുകളില്‍ തടവ് ശിക്ഷ ലഭിച്ചാല്‍ ആ വ്യക്തി ജനപ്രതിനിധി സ്ഥാനത്തിന് അയോഗ്യനാകും. അതിനാല്‍ ആന്റണി രാജുവിന് എംഎല്‍എ സ്ഥാനം നഷ്ടമാകാന്‍ സാധ്യതയുണ്ട്.

Summary:  Following a 32-year-long legal battle in the evidence tampering case, the Nedumangad Judicial First Class Magistrate Court has sentenced former Minister and current MLA Antony Raju to three years of rigorous imprisonment and a fine. Antony Raju is the second accused in the case. With the sentence exceeding two years, he faces disqualification as a legislator.

The court also found the first accused, K.S. Jose, a former bench clerk of the court, guilty. The charges proven include destruction of evidence, criminal conspiracy, and tampering with official court records.

The Case History In 1990, an Australian citizen named Andrew Salvatore Cervelli was apprehended at the Thiruvananthapuram airport with narcotics. The hashish was found concealed inside his innerwear.

Antony Raju was the defense lawyer for the accused in that case. The prosecution's case was that Antony Raju, in collusion with court staff member Jose, took the innerwear (which was in court custody as material evidence), altered it by cutting and stitching it to make it smaller, and then returned it.

Consequently, when the case reached the High Court, the defense argued that the innerwear was too small for the accused to wear. Accepting this argument, the court acquitted the accused.

The Turning Point The case took a turn after the acquitted individual returned to his home country and was jailed there for another crime. During his imprisonment, he revealed to a fellow inmate that he escaped conviction in Kerala because the material evidence (thondi) had been tampered with. This information eventually led to a case being registered against Antony Raju in 1994.

Current Situation Following the verdict, Antony Raju announced that he would approach a higher court. With the conviction, the demand for his resignation as an MLA has intensified. This development is expected to trigger major discussions within the LDF (Left Democratic Front) alliance.

While a stay on the conviction could prevent immediate resignation, Antony Raju will be unable to contest future elections if a stay is not granted. According to Supreme Court rulings, any individual sentenced to two years or more of imprisonment is disqualified from being a representative of the people. Therefore, Antony Raju is at high risk of losing his MLA seat.
