Unnao Rape Case: Conviction of Former BJP MLA Sengar Suspended; CRPF Manhandles Protesting Girl and Mother

ന്യൂഡല്ഹി : 2019 ഡിസംബറില് ഉന്നാവില് പ്രായപൂര്ത്തിയാകാത്ത പെണ്കുട്ടിയെ തട്ടിക്കൊണ്ടുപോയി പീഡിപ്പിച്ച കേസില് ബിജെപി മുന് എം എല് എ കുല്ദീപ് സിംഗ് സെന്ഗറിനു വിചാരണക്കോടതി വിധിച്ച മരണം വരെയുള്ള ജീവപര്യന്തം തടവുശിക്ഷ ഡല്ഹി ഹൈക്കോടതി മരവിപ്പിച്ചു. അതിജീവിതയുടെ അച്ഛനെ കള്ളക്കേസില് കുടുക്കി ജയിലിലടയ്ക്കുകയും അവിടെ വച്ച് മര്ദ്ദിച്ച് കൊലപ്പെടുത്തുകയും ചെയ്ത കുറ്റവും ഇയാള്ക്കു മേലുണ്ട്.
തടവിനൊപ്പം 25 ലക്ഷം രൂപ പിഴയും ചുമത്തിയിരുന്നു. ഈ ശിക്ഷയ്ക്കെതിരെ സെന്ഗര് നല്കിയ അപ്പീല് പരിഗണിക്കുന്നതിനിടെയാണ് ഡല്ഹി ഹൈക്കോടതി ഇയാള്ക്ക് ജാമ്യം അനുവദിച്ചത്.
കൊലക്കേസില് 10 വര്ഷം കഠിനതടവാണ് സെന്ഗറിന് ലഭിച്ചത്. ഈ കേസില് ജാമ്യം ലഭിക്കാത്തതിനാല്, പീഡനക്കേസില് ഹൈക്കോടതി ജാമ്യം നല്കിയാലും സെന്ഗറിന് ഉടന് ജയിലില് നിന്ന് പുറത്തിറങ്ങാന് കഴിയില്ല.
ഇതിനിടെ, വിധി വന്നതിനു പിന്നാലെ ഡല്ഹിയിലെ ഇന്ത്യാ ഗേറ്റിന് മുന്നില് പ്രതിഷേധിക്കുകയായിരുന്ന പീഡനത്തിനിരയായ പെണ്കുട്ടിയെയും അമ്മയെയും സിആര്പിഎഫ് ബലംപ്രയോഗിച്ച് നീക്കം ചെയ്തു. മാധ്യമങ്ങളെ കാണുന്നതില് നിന്ന് ഇരുവരെയും തടഞ്ഞ സിആര്പിഎഫ്, പ്രായമായ അമ്മയെ ഓടിക്കൊണ്ടിരുന്ന ബസ്സില് നിന്ന് തള്ളിയിടാന് ശ്രമിച്ചതായും പരാതിയുണ്ട്. കുട്ടിയുടെ അമ്മയെ പൊലീസ് തെരുവില് വലിച്ചിഴച്ചു. ഇവരുടെ സമരത്തെ ഉത്തര്പ്രദേശ് മന്ത്രി ഒ.പി. രാജ്ഭര് പരിഹസിച്ചു.

പെണ്കുട്ടിയെ പ്രതിഷേധ സ്ഥലത്ത് നിന്ന് നീക്കം ചെയ്തതിനെക്കുറിച്ച് ചോദിച്ചപ്പോള്, 'അവളുടെ വീട് ഉന്നാവിലല്ലേ...' എന്ന് പറഞ്ഞ് മന്ത്രി ചിരിക്കുകയായിരുന്നു.
പോലീസിന്റെ നടപടിയില് മനംനൊന്ത് ആത്മഹത്യ ചെയ്യാന് പോലും തോന്നിയെന്നും എന്നാല് കുടുംബത്തെ ഓര്ത്ത് പിന്മാറിയെന്നും പെണ്കുട്ടി പറഞ്ഞു. 'പണമുള്ളവര് ജയിക്കുന്നു, പണമില്ലാത്തവര് തോല്ക്കുന്നു' എന്നും അവര് കൂട്ടിച്ചേര്ത്തു.
2017-ലെ പീഡനക്കേസില് ജീവപര്യന്തം തടവിന് ശിക്ഷിക്കപ്പെട്ട സെന്ഗറിന്റെ ശിക്ഷ ഹൈക്കോടതി മരവിപ്പിക്കുകയായിരുന്നു. ഇരയുടെ വീടിന്റെ അഞ്ചു കിലോമീറ്റര് ചുറ്റളവില് പ്രവേശിക്കരുത് എന്ന നിബന്ധനയോടെയാണ് ജാമ്യം.
തങ്ങള്ക്കുള്ള സുരക്ഷ പിന്വലിച്ചതായും പ്രതിക്ക് ജാമ്യം ലഭിച്ചത് കുടുംബത്തിന് 'മരണം' പോലെയാണെന്നും ഇരയായ പെണ്കുട്ടി പറഞ്ഞു. ഈ വിധിക്കെതിരെ സുപ്രീം കോടതിയെ സമീപിക്കാനാണ് അവരുടെ തീരുമാനം.
നിലവില്, പെണ്കുട്ടിയും അമ്മയും മുതിര്ന്ന കോണ്ഗ്രസ് നേതാക്കളായ സോണിയാ ഗാന്ധിയെയും രാഹുല് ഗാന്ധിയെയും അവരുടെ വസതിയില് എത്തി കണ്ടു. പൊലീസ് പെണ്കുട്ടിയുടെ അമ്മയെ കൈയേറ്റം ചെയ്തതിന് മണിക്കൂറുകള്ക്ക് ശേഷമായിരുന്നു ഈ കൂടിക്കാഴ്ച. സോണിയാ ഗാന്ധിയുടെ വസതിയായ 10 ജന്പഥിലായിരുന്നു കൂടിക്കാഴ്ച നടന്നത്. ജര്മ്മനി സന്ദര്ശനം കഴിഞ്ഞ് മടങ്ങിയെത്തിയ രാഹുല് ഗാന്ധിക്കൊപ്പം സോണിയാ ഗാന്ധിയും കുട്ടിയുമായും അമ്മയുമായും സംസാരിച്ചു.
നീതിക്ക് വേണ്ടി ശബ്ദമുയര്ത്തുന്നതിനാണോ അതിജീവിതയോട് ഇത്തരത്തില് മോശമായി പെരുമാറുന്നതെന്ന് രാഹുല് ഗാന്ധി ചോദിച്ചു. കൂട്ടബലാത്സംഗ ഇരയോടുള്ള ഇത്തരം പെരുമാറ്റം ന്യായമാണോ? ബലാത്സംഗം ചെയ്തവര്ക്ക് ജാമ്യം നല്കുകയും അതിജീവിച്ചവരോട് കുറ്റവാളികളെപ്പോലെ പെരുമാറുകയും ചെയ്യുന്നത് എന്ത് നീതിയാണ്? നമ്മള് ഒരു മൃത സമൂഹമായി മാറിക്കൊണ്ടിരിക്കുകയുമാണ്,' അദ്ദേഹം എക്സില് കുറിച്ചു.
2019 ല് അതിജീവിതയും അഭിഭാഷകനും സഞ്ചരിച്ചിരുന്ന കാറില് ട്രക്ക് ഇടിച്ച് വന് അപകടമുണ്ടായി. ഇതില് പെണ്കുട്ടിയുടെ രണ്ട് ബന്ധുക്കള് കൊല്ലപ്പെടുകയും പെണ്കുട്ടിക്ക് ഗുരുതരമായി പരിക്കേല്ക്കുകയും ചെയ്തിരുന്നു. ഇത് കൊലപാതക ശ്രമമാണെന്ന് ആരോപിക്കപ്പെട്ടിരുന്നു.
തങ്ങള്ക്കും സാക്ഷികള്ക്കും നല്കിയിരുന്ന സുരക്ഷാ ഉദ്യോഗസ്ഥരെ ഇപ്പോള് പിന്വലിച്ചതായി അതിജീവിത പറഞ്ഞു. പ്രതിക്ക് രാഷ്ട്രീയ സ്വാധീനം ഉള്ളതിനാല് ജാമ്യം ലഭിക്കുന്നത് തങ്ങളുടെ ജീവന് ഭീഷണിയാണെന്ന് കുടുംബം ഭയപ്പെടുന്നു.

Protests and Police Action
Following the verdict, the rape survivor and her mother, who were protesting in front of Delhi’s India Gate, were forcibly removed by the CRPF. There are allegations that the CRPF personnel prevented them from addressing the media and even attempted to push the elderly mother off a moving bus. The survivor's mother was reportedly dragged through the streets.
Reacting to their protest, Uttar Pradesh Minister O.P. Rajbhar mocked the family. When asked about the removal of the girl from the protest site, the minister reportedly laughed and remarked, "Isn't her home in Unnao?"
The survivor expressed deep distress over the police action, stating she felt suicidal but held back for the sake of her family. "Those with money win, and those without it lose," she added.
Threats and Legal Battle
The High Court suspended the life sentence with a condition that Sengar must not enter within a five-kilometer radius of the victim’s house. However, the survivor stated that their security detail has been withdrawn and described the bail for the accused as "death" for her family. They intend to approach the Supreme Court against this verdict.
Meeting with Congress Leaders
The survivor and her mother met senior Congress leaders Sonia Gandhi and Rahul Gandhi at their residence, 10 Janpath. This meeting occurred hours after the mother was allegedly manhandled by the police. Rahul Gandhi, who recently returned from a visit to Germany, discussed the situation with them alongside Sonia Gandhi.
Rahul Gandhi questioned the treatment of the survivor on X (formerly Twitter): "Is such treatment of a gang-rape victim justified? What kind of justice is it to grant bail to rapists while treating survivors like criminals? We are turning into a dead society," he wrote.
Background of the Case
In 2019, the survivor and her lawyer were involved in a massive road accident when a truck rammed into their car, killing two of her relatives and leaving her critically injured. It was widely alleged to be an attempted murder.
The family now fears for their lives as the accused has significant political influence and their security personnel and witnesses' guards have reportedly been withdrawn.
