കൊച്ചി : സിഎംആര്‍എല്‍-എക്‌സാലോജിക്  മാസപ്പടി ആരോപണത്തിലും കള്ളപ്പണം വെളുപ്പിക്കല്‍ കേസില്‍ലും എന്‍ഫോഴ്‌സ്‌മെന്റ് ഡയറക്ടറേറ്റ് (ഇ.ഡി) കൊച്ചി ഹാജരാകുന്നിതില്‍ അവധി ചോദിച്ച് പ്രതിപക്ഷ നേതാവിന്റെ മകള്‍ വീണാ വിജയന്‍. ഇ.ഡി കൊച്ചി യൂണിറ്റില്‍ നാളെ (ജൂണ്‍ 12, വെള്ളിയാഴ്ച) ഹാജരാകാന്‍ നല്‍കിയ സമന്‍സിലാണ്  വീണ അവധി അപേക്ഷ നല്‍കിയിരിക്കുന്നത്.

 ശാരീരികമായ അസ്വാസ്ഥ്യങ്ങള്‍ ചൂണ്ടിക്കാണിച്ചാണ് വീണ ഹാജരാകുന്നതില്‍നിന്ന് ഇളവ് തേടിയിരിക്കുന്നത്. താന്‍ നേരിട്ട് ഹാജരാകുന്നതിന് പകരം, അന്വേഷണ ഉദ്യോഗസ്ഥന്‍ ആവശ്യപ്പെട്ടിട്ടുള്ള മുഴുവന്‍ രേഖകളും മറുപടിയും തന്റെ അഭിഭാഷകന്‍ വഴി സമര്‍പ്പിക്കാന്‍ തയ്യാറാണെന്ന് വീണ ഇ.ഡിയെ അറിയിച്ചു.

ബുധനാഴ്ച രാവിലെയാണ് അവധി ചോദിച്ചുകൊണ്ടുള്ള കത്ത് ഇ.ഡി ഓഫിസില്‍ ലഭിച്ചത്. വീണയുടെ അപേക്ഷയില്‍ ഇ.ഡി ഇന്ന് അന്തിമ തീരുമാനം എടുക്കും. എന്നാല്‍ ഈ കേസിലെ നിയമസാധുതകള്‍ പരിശോധിക്കുമ്പോള്‍ വീണയ്ക്ക് കാര്യങ്ങള്‍ അത്ര എളുപ്പമാകില്ലെന്നാണ് പുറത്തുവരുന്ന വിവരം.

സാധാരണയായി അനാരോഗ്യം കാരണമായി ചൂണ്ടിക്കാണിക്കുമ്പോള്‍ കൃത്യമായ മെഡിക്കല്‍ സര്‍ട്ടിഫിക്കറ്റുകളും പരിശോധനാ രേഖകളും ഹാജരാക്കിയാല്‍ മാത്രമേ ഇ.ഡി അത് പരിഗണിക്കാറുള്ളൂ. കള്ളപ്പണം വെളുപ്പിക്കല്‍ തടയല്‍ നിയമത്തിലെ വകുപ്പ് 50 പ്രകാരമാണ് വീണയ്ക്ക് സമന്‍സ് അയച്ചിരിക്കുന്നത്. ഈ വകുപ്പ് പ്രകാരം സമന്‍സ് ലഭിച്ച വ്യക്തി നേരിട്ട് തന്നെ ഹാജരാകണം.

ഈ വകുപ്പ് പ്രകാരം നല്‍കുന്ന മൊഴികള്‍ ഒരു സിവില്‍ കോടതിക്ക് നല്‍കുന്നതിന് തുല്യമാണ്. സത്യപ്രസ്താവനയോടെ മൊഴി രേഖപ്പെടുത്തേണ്ടതിനാല്‍ അഭിഭാഷകന്‍ വഴി രേഖകള്‍ നല്‍കുന്നത് ഇ.ഡി അംഗീകരിക്കാന്‍ സാധ്യതയില്ല.

ഈ അവധി അപേക്ഷ തള്ളുകയാണെങ്കില്‍ വീണ നാളെ ഹാജരാകേണ്ടി വരും. ഒരു തവണ അവധി അനുവദിച്ചാല്‍ പോലും അടുത്ത തവണ വീണ നേരിട്ട് തന്നെ ഹാജരാകേണ്ടി വരുമെന്ന് നിയമവിദഗ്ധര്‍ ചൂണ്ടിക്കാട്ടുന്നു.

നേരത്തെ ഈ കേസില്‍ എസ്എഫ്‌ഐഒ ശേഖരിച്ച 134 സുപ്രധാന രേഖകള്‍ ഇ.ഡിക്ക് കൈമാറാന്‍ പ്രത്യേക പി.എം.എല്‍.എ കോടതി ഉത്തരവിട്ടിരുന്നു. ഇതിന് പിന്നാലെയാണ് വീണ ഉള്‍പ്പെടെയുള്ള ഒന്‍പത് പേര്‍ക്ക് ഇ.ഡി സമന്‍സ് അയച്ചത്. സിഎംആര്‍എല്‍ എംഡി ശശിധരന്‍ കര്‍ത്ത ഉള്‍പ്പെടെയുള്ളവരോടും ഹാജരാകാന്‍ നിര്‍ദേശിച്ചിട്ടുണ്ട്.

Summary: In the ongoing money laundering case related to the CMRL-Exalogic "monthly payoff" allegations, Veena Vijayan, daughter of the Chief Minister, has requested more time to appear before the Enforcement Directorate (ED). The ED's Kochi unit had issued a summons for her to appear tomorrow (Friday, June 12).

Veena sought the exemption citing physical ailments. In her letter to the ED, she stated that instead of appearing in person, she is prepared to submit all requested documents and responses through her counsel. The ED office received the email request on Wednesday morning.

While the ED is expected to make a final decision on her application today, legal experts suggest that the path ahead may not be easy for her due to the following reasons:

Medical Documentation: Generally, the ED considers exemptions on health grounds only if they are supported by valid medical certificates and diagnostic reports.

Section 50 of PMLA: The summons was issued under Section 50 of the Prevention of Money Laundering Act (PMLA). Under this provision, the individual summoned is legally mandated to appear in person.

Judicial Validity: Statements recorded under this section are equivalent to proceedings in a civil court. Since the testimony must be recorded under oath, the ED is unlikely to allow a lawyer to submit documents on her behalf.

Future Appearance: Experts point out that even if a one-time extension is granted, Veena will eventually have to appear before the agency in person.
