തിരുവനന്തപുരം: കേരളത്തിന്റെ ഭരണചരിത്രത്തില്‍ മുന്‍പെങ്ങും ഇല്ലാത്തവിധം, കേരള പബ്ലിക് സര്‍വീസ് കമ്മിഷന്‍ ചെയര്‍മാനെയും അംഗങ്ങളെയും പദവിയില്‍ നിന്ന് നീക്കം ചെയ്യണമെന്ന് കേരള ഗവര്‍ണര്‍ രാജേന്ദ്ര വിശ്വനാഥ് ആര്‍ലേക്കര്‍ സ്ഥാനമൊഴിയുന്നതിനു തൊട്ടുമുന്‍പ് രാഷ്ട്രപതിയോട് ഔദ്യോഗികമായി ശുപാര്‍ശ ചെയ്തു. കഴിഞ്ഞ ഇടതു സര്‍ക്കാര്‍ കാലത്തു നിയമിക്കപ്പെട്ടവരാണ് ചെയര്‍മാനും അംഗങ്ങളും.

നിലവിലെ പി.എസ്.സി ചെയര്‍മാനെയും അംഗങ്ങളെയും പുറത്താക്കാന്‍ കേരള ഗവര്‍ണര്‍ ഭരണഘടനാപരമായ നടപടികള്‍ സ്വീകരിക്കുന്നത് ചരിത്രത്തില്‍ ആദ്യമായാണ്. കേരള പി.എസ്.സി നടത്തിയ നിയമന പരീക്ഷകളില്‍ (സ്റ്റേറ്റ് പ്ലാനിംഗ് ബോര്‍ഡ് നിയമന പരീക്ഷ അടക്കം പ്രമുഖ പരീക്ഷകളില്‍) ഗുരുതരമായ ക്രമക്കേടുകള്‍ നടന്നു എന്ന ആരോപണങ്ങളെയും വ്യാപകമായ പരാതികളെയും തുടര്‍ന്നാണ് രാജ്ഭവന്‍ ഈ ശുപാര്‍ശ നല്‍കിയത്.

ക്രൈംബ്രാഞ്ച് അന്വേഷണ സംഘത്തിന്റെ വിവരങ്ങളും നിയമോപദേശങ്ങളും ഉള്‍പ്പെടെയുള്ള റിപ്പോര്‍ട്ടുകള്‍ തേടിയ ശേഷമാണ് ഗവര്‍ണര്‍ തീരുമാനമെടുത്തത്. വിവിധ പരീക്ഷാ പരാതികളിന്മേലുള്ള അന്വേഷണത്തിന്റെ പുരോഗതിയിലും അത് കൈകാര്യം ചെയ്ത രീതിയിലും അതൃപ്തി ഉയര്‍ന്നതാണ് തുടര്‍നടപടിക്ക് കാരണമായത്.

ഭരണഘടനാപരമായ സ്വയംഭരണാവകാശം ഉറപ്പാക്കുന്നതിനായി സ്റ്റേറ്റ് പബ്ലിക് സര്‍വീസ് കമ്മിഷന്‍ അംഗങ്ങള്‍ക്ക് പ്രത്യേക പരിരക്ഷ നല്‍കിയിട്ടുണ്ട്. ഇതിനാലാണ് രാഷ്ട്രപതിക്കു ശുപാര്‍ശ ചെയ്തത്.  പി.എസ്.സി ചെയര്‍മാനെയും അംഗങ്ങളെയും നിയമിക്കാന്‍ ഗവര്‍ണര്‍ക്ക് അധികാരമുണ്ടെങ്കിലും, അവരെ പദവിയില്‍ നിന്ന് നീക്കം ചെയ്യാന്‍  രാഷ്ട്രപതിക്ക് മാത്രമേ ഭരണഘടനാപരമായ അധികാരമുള്ളൂ. 

ഗവര്‍ണറുടെ റിപ്പോര്‍ട്ട് ലഭിച്ചാല്‍ രാഷ്ട്രപതി ഈ വിഷയം ഔദ്യോഗിക അന്വേഷണത്തിനായി സുപ്രീം കോടതിക്ക് വിടേണ്ടതുണ്ട്. വിഷയം സുപ്രീം കോടതിക്ക് വിട്ടുകഴിഞ്ഞാല്‍, അന്വേഷണഫലം വരുന്നതുവരെ പി.എസ്.സി ചെയര്‍മാനെയും അംഗങ്ങളെയും സസ്‌പെന്‍ഡ് ചെയ്യാനുള്ള ഭരണഘടനാപരമായ അധികാരം ഗവര്‍ണര്‍ക്ക് ലഭിക്കുന്നു.  ചെയര്‍മാനെയും അംഗങ്ങളെയും നീക്കം ചെയ്യണമെന്ന് സുപ്രീം കോടതി അന്വേഷണത്തിന് ശേഷം റിപ്പോര്‍ട്ട് നല്‍കിയാല്‍ മാത്രമേ രാഷ്ട്രപതിക്ക് അന്തിമ പുറത്താക്കല്‍ ഉത്തരവ് പുറപ്പെടുവിക്കാന്‍ സാധിക്കൂ.

പി.എസ്.സി നടത്തിയ മത്സരപരീക്ഷകളിലെ ക്രമക്കേടുകളും സാങ്കേതിക തകരാറുകളും സംബന്ധിച്ച് നൂറിലധികം പരാതികളാണ് ഗവര്‍ണറുടെ ഓഫീസിന് ലഭിച്ചത്. പരീക്ഷാ ക്രമക്കേടുകളില്‍ വ്യക്തത വരുത്താന്‍ ഗവര്‍ണര്‍ ആര്‍ലേക്കര്‍ മുമ്പ് പി.എസ്.സി സെക്രട്ടറിയെ രാജ്ഭവനിലേക്ക് വിളിച്ചുവരുത്തുകയും, രാഷ്ട്രപതിക്ക് റിപ്പോര്‍ട്ട് നല്‍കുന്നതിന് മുന്‍പായി മുതിര്‍ന്ന നിയമവിദഗ്ധരില്‍ നിന്ന് ഉപദേശം തേടുകയും ചെയ്തിരുന്നു. ഗവര്‍ണറുടെ കര്‍ശന നിലപാട് സംസ്ഥാനത്ത് വലിയ രാഷ്ട്രീയ ചര്‍ച്ചകള്‍ക്ക് വഴിതെളിച്ചിട്ടുണ്ട്.

In an unprecedented move in the administrative history of Kerala, just before demitting office, Kerala Governor Rajendra Vishwanath Arlekar officially recommended to the President of India that the Chairman and members of the Kerala Public Service Commission (PSC) be removed from their posts. The Chairman and members were appointed during the previous Left Democratic Front (LDF) government's tenure.

This is the first time in history that a Kerala Governor has initiated constitutional proceedings to dismiss the sitting PSC Chairman and members. Raj Bhavan made this recommendation following widespread complaints and allegations of severe irregularities in recruitment examinations conducted by the Kerala PSC (including prominent exams such as the State Planning Board recruitment exam).

The Governor took this decision after seeking reports, including inputs from the Crime Branch investigation team and legal advice. Discontent over the progress of investigations into various exam-related complaints and the manner in which they were handled led to this follow-up action.

To ensure constitutional autonomy, members of a State Public Service Commission are granted special protection. This is why the recommendation was forwarded to the President. Although the Governor has the authority to appoint the PSC Chairman and members, only the President of India holds the constitutional power to remove them from office. Upon receiving the Governor's report, the President must refer the matter to the Supreme Court for an official inquiry.

Once the matter is referred to the Supreme Court, the Governor gains the constitutional power to suspend the PSC Chairman and members pending the outcome of the inquiry. The President can issue the final dismissal order only if the Supreme Court submits a report following its inquiry recommending their removal on grounds of misbehavior or disqualification.

The Governor's office received over a hundred complaints regarding irregularities and technical glitches in the competitive examinations conducted by the PSC. Governor Arlekar had previously summoned the PSC Secretary to Raj Bhavan to clarify the exam irregularities and sought advice from senior legal experts before submitting the report to the President. The Governor's strict stance has sparked major political discussions in the state.
