Remove Barricades Immediately: Supreme Court Directs Central Government
News in English:
Supreme Court states that subject to public order regulations, people's freedom of movement should be normalized.
Holding a special weekend sitting today to hear petitions against the closure of Delhi Metro stations following protests by the Cockroach Janata Party (CJP), the Supreme Court ordered the removal of all barricades "unless there is absolute emergency."
The court also directed authorities to withdraw the enforcement of Section 163 of the 2023 Bharatiya Nagarik Suraksha Sanhita (BNSS), which prohibits large gatherings.
"We have come to know that an order under Section 163 has been issued around the Supreme Court. We order that the authorities withdraw these restrictions to ensure that there is no obstruction to entering or exiting the Supreme Court or other courts," specified the bench comprising Justices Joymalya Bagchi and V. Mohana.
The court also emphasized that despite the CJP's call for protest, people's free movement must be ensured, subject to reasonable restrictions regarding public order.
When the case was heard on Friday, a bench comprising Chief Justice Surya Kant and Justices Bagchi and Mohana had directed the Central Government not to completely prohibit the movement of metros and trains coming into Delhi on October 10 due to the protests. The court reminded that everything cannot be brought to a standstill.
However, metro stations remained closed. The petitioner and advocate Shailendra Mani Tripathi pointed out that this amounted to contempt of court. The bench clarified that citizens have the right to protest, but it must be within the framework of police laws.
"You have the right to protest, there is no dispute about that. But the manner of protesting must be subject to police law," the Supreme Court remarked.
Justice Bagchi clarified to the petitioner that the right to protest cannot be said to transcend police law. Subsequently, the Supreme Court issued notices to authorities, including the Delhi Police, Union Home Secretary, and the Delhi Metro Rail Corporation (DMRC), regarding the detention of individuals. The court also ordered them to submit a compliance report by Tuesday.
The CJP and opposition parties are protesting demanding the resignation of Chief Election Commissioner Gyanesh Kumar, alleging irregularities in the SIR process.
The Supreme Court also heard concerns raised by lawyers during the special sitting. The court directed the police to ensure that lawyers face no hindrance in carrying out their professional duties. At the same time, the court reminded lawyers that if they have genuine concerns, they should protest peacefully without provoking people.
