ന്യൂഡല്ഹി: കോക്ക്റോച്ച് ജനതാ പാര്ട്ടി (സി ജെ പി) നേതാക്കളായ അഭിജിത് ദിപ്കെ, സൗരവ് ദാസ്, അശുതോഷ് റാങ്ക എന്നിവരെ ഒരു വര്ഷത്തേക്ക് ക്രമസമാധാന ലംഘനം നടത്തരുതെന്ന വ്യവസ്ഥയില് ഞായറാഴ്ച ഡല്ഹിയിലെ എക്സിക്യൂട്ടീവ് മജിസ്ട്രേറ്റ് കോടതി കരുതല് തടങ്കലില് നിന്ന് മോചിപ്പിച്ചു.
ഈ കാലയളവില് സമാധാനവും നല്ല പെരുമാറ്റവും നിലനിര്ത്തുന്നതിനായി 50,000 രൂപയുടെ സ്യൂരിറ്റി ബോണ്ട് നല്കിയിട്ടുണ്ട്. എന്നാല് ഇവര്ക്ക് ഇനി സമാധാനപരമായ പ്രതിഷേധങ്ങളില് പങ്കെടുക്കാന് സാധിക്കുമോ എന്നത് ഇതുവരെ വ്യക്തമല്ല.
ചീഫ് ഇലക്ഷന് കമ്മിഷണര് ഗ്യാനേഷ് കുമാറിന്റെ രാജിയാവശ്യപ്പെട്ട് നടത്താനിരുന്ന പ്രതിഷേധത്തിന് മുന്നോടിയായി, ശനിയാഴ്ച ഡല്ഹിയില് വിമാനമിറങ്ങിയ ഉടന് എയര് ഇന്ത്യ വിമാനത്തിനുള്ളില് വച്ചാണ് മൂന്ന് നേതാക്കളെയും ഡല്ഹി പോലീസ് കസ്റ്റഡിയിലെടുത്തത്. പിന്നീട് ഡല്ഹി കന്റോണ്മെന്റിലെ അഡിഷണല് സിറ്റി മജിസ്ട്രേറ്റ് കോടതിയില് ഇവരെ ഹാജരാക്കി. ഭാരതീയ നാഗരിക് സുരക്ഷാ സംഹിത പ്രകാരമുള്ള 126, 170 വകുപ്പുകള് ചുമത്തി ശനിയാഴ്ചയാണ് ഇവരെ കരുതല് തടങ്കലിലാക്കിയത്.

നേരത്തെ, സി.ജെ.പിയുടെ ലീഗല് ടീം മേധാവി രത്ന സിംഗ് പങ്കുവച്ച കുറിപ്പില്, നേതാക്കളെ മജിസ്ട്രേറ്റിന് മുന്നില് ഹാജരാക്കുന്ന വിവരം ഡല്ഹി പോലീസ് ഉദ്യോഗസ്ഥന് അറിയിച്ചതായി വ്യക്തമാക്കിയിരുന്നു. പാര്ട്ടി അഭിഭാഷകര്ക്കൊപ്പം ഡല്ഹി കന്റോണ്മെന്റ് പോലീസ് സ്റ്റേഷനില് താനുണ്ടാകുമെന്നും അവര് അറിയിച്ചിരുന്നു.
ഇതേസമയം, പ്രതിഷേധത്തിന് തൊട്ടുമുമ്പ് ഗുഡ്ഗാവിലെ വസതിയില് നിന്ന് കസ്റ്റഡിയിലെടുത്ത യൂട്യൂബറും ഇന്ഫ്ളുവന്സറുമായ ധ്രുവ് റാഠിയെ ഞായറാഴ്ച പുലര്ച്ചെ മൂന്നു മണിയോടെ മോചിപ്പിച്ചു.
എന്താണ് കരുതല് തടങ്കല്? ഇനി എന്ത് സംഭവിക്കും?
ഒരാള് കുറ്റം ചെയ്യുന്നതോ പൊതുസമാധാനം തകര്ക്കുന്നതോ തടയുന്നതിനാണ് കരുതല് തടങ്കല് ഉപയോഗിക്കുന്നത്. നിയമപരമായ നടപടിക്രമങ്ങള് അനുസരിച്ച്, സമാധാനലംഘനം തടയാന് പോലീസിന് വ്യക്തികളെ കസ്റ്റഡിയിലെടുക്കാം.
കസ്റ്റഡിയിലെടുത്തതിന് പിന്നാലെ നടപടിക്രമങ്ങളുടെ ഭാഗമായി മൂന്ന് സി.ജെ.പി നേതാക്കളെയും സ്പെഷ്യല് എക്സിക്യൂട്ടീവ് മജിസ്ട്രേറ്റിന് മുന്നില് ഹാജരാക്കി. ബി.എന്.എസ്.എസ് 126ാം വകുപ്പ് സമാധാനം നിലനിര്ത്തുന്നതിന് ബോണ്ട് സമര്പ്പിക്കാന് ആവശ്യപ്പെടുന്നു. എന്നാല് 170-ാം വകുപ്പ് സംജ്ഞേയ കുറ്റകൃത്യങ്ങള് നടക്കുന്നത് തടയാന് മുന്കൂട്ടി അറസ്റ്റ് ചെയ്യാന് പോലീസിന് അധികാരം നല്കുന്നു.
വറന്റില്ലാതെ അറസ്റ്റ് ചെയ്യുമ്പോള്, ഉചിതമായ ജുഡിഷ്യല് അനുമതിയില്ലാതെ 24 മണിക്കൂറില് കൂടുതല് വ്യക്തിയെ കസ്റ്റഡിയില് വയ്ക്കാന് കഴിയില്ല. വ്യക്തിയെ മജിസ്ട്രേറ്റിന് മുന്നില് ഹാജരാക്കുന്നത് അനാവശ്യമായി തടങ്കലില് വയ്ക്കുന്നത് തടയാനുള്ള പ്രധാന സംരക്ഷണമാണ്.
പഴയ സി.ആര്.പി.സിയിലെ 107, 151 വകുപ്പുകള്ക്ക് പകരമായി നിലവിലെ ബി.എന്.എസ്.എസില് നല്കിയിട്ടുള്ള വകുപ്പുകളാണ് 126, 170 എന്നിവ. ബി.എന്.എസ്.എസ് 170-ാം വകുപ്പ് അനുസരിച്ച് തടയാന് കഴിയില്ലെന്ന് വിശ്വസിക്കുന്ന സാഹചര്യത്തില് അറസ്റ്റ് ചെയ്യാമെങ്കിലും, മറ്റു നിയമപരമായ അനുമതികളില്ലെങ്കില് 24 മണിക്കൂറാണ് പരമാവധി തടങ്കല് സമയം.
ജന്തര് മന്തറിലേക്ക് വീണ്ടും മാര്ച്ച് വിളിച്ച് സി.ജെ.പി
മുതിര്ന്ന നേതാക്കളുടെ അറസ്റ്റിന് ശേഷവും ഞായറാഴ്ച രാവിലെ 10 മണിക്ക് ജന്തര് മന്തറിലേക്ക് വീണ്ടും പ്രതിഷേധമാര്ച്ച് നടത്താന് സി.ജെ.പി ആഹ്വാനം ചെയ്തു. വോട്ടര് പട്ടികയിലെ കൃത്രിമത്വം ആരോപിച്ചാണ് ഗ്യാനേഷ് കുമാറിനെതിരെ സമരം ശക്തമാക്കുന്നത്.
പ്രതിഷേധം തടയുന്നതിനായി ശനിയാഴ്ച ഡല്ഹിയില് വ്യാപക സുരക്ഷാ ക്രമീകരണങ്ങളാണ് പോലീസ് ഏര്പ്പെടുത്തിയത്. സുരക്ഷാ പ്രശ്നങ്ങള് മുന്നിര്ത്തി പ്രതിഷേധത്തിന് പോലീസ് അനുമതി നിഷേധിച്ചിരുന്നു.
പ്രതിഷേധം തടയുന്നതിന്റെ ഭാഗമായി ശനിയാഴ്ച ഡല്ഹിയിലുടനീളം 3,000-ത്തിലധികം ആളുകളെ പോലീസ് കസ്റ്റഡിയിലെടുത്തു. 20,000-ത്തിലധികം പോലീസുകാരെയും കേന്ദ്ര സായുധ പോലീസിനെയും തലസ്ഥാനത്ത് വിന്യസിച്ചിരുന്നു. ജന്തര് മന്തറിന് ചുറ്റും മാത്രം 6,500 ഓളം ഉദ്യോഗസ്ഥരെ നിയോഗിച്ചു.
കണോട്ട് പ്ലേസില് നിന്ന് മാത്രം 150 ഓളം പേരെ കസ്റ്റഡിയിലെടുത്തു. കൂടാതെ കരുതല് നടപടിയെന്ന നിലയില് മുന്കാല ക്രിമിനല് പശ്ചാത്തലമുള്ള 600-ലധികം ആളുകളെയും പോലീസ് കസ്റ്റഡിയിലെടുത്തു.
സുരക്ഷാ നടപടികള് തലസ്ഥാനത്തെ പൊതുഗതാഗതത്തെ ബാധിച്ചു. നിരവധി മെട്രോ സ്റ്റേഷനുകള് അടച്ചിടുകയും ട്രെയിന് സര്വീസുകള് റദ്ദാക്കുകയും ചെയ്തു. ജനപഥ്-കര്ത്തവ്യ പഥ് പ്രദേശത്തിന് 4 കിലോമീറ്റര് ചുറ്റളവില് മൊബൈല് ഇന്റര്നെറ്റ് സര്വീസുകള് താത്കാലികമായി നിര്ത്തിവച്ചു. ഡല്ഹി-നോയിഡ അതിര്ത്തിയിലും കര്ശന പരിശോധനകള് ഏര്പ്പെടുത്തി. ശനിയാഴ്ച രാത്രിയോടെയാണ് മെട്രോ സ്റ്റേഷന് കവാടങ്ങള് തുറന്ന് ഗതാഗതം പുനഃസ്ഥാപിച്ചത്.
News in English: Cockroach Janata Party (CJP) leaders Abhijit Dipke, Sourav Das, and Ashutosh Ranga were released from preventive detention by a Delhi Executive Magistrate Court on Sunday on the condition that they do not breach public peace for one year.
To maintain peace and good behavior during this period, a surety bond of 50,000 rupees has been submitted. However, it remains unclear whether they will be able to participate in peaceful protests henceforth.
Ahead of a planned protest demanding the resignation of Chief Election Commissioner Gyanesh Kumar, the three leaders were taken into custody by Delhi Police on Saturday right after landing at the Delhi airport inside an Air India flight. They were later produced before the Additional City Magistrate Court in Delhi Cantonment. They were placed under preventive detention on Saturday under sections 126 and 170 of the Bharatiya Nagarik Suraksha Sanhita (BNSS).
Meanwhile, sharing the note for the CJP press conference scheduled for 2 PM to announce future plans, it stated: "Finally, Delhi Police were forced to release Abhijit Dipke, Ashutosh Ranga, and Sourav Das. CJP has the resilience to withstand maintenance."
Earlier, Ratna Singh, head of CJP's legal team, shared a note stating that a Delhi Police official informed her about the leaders being produced before the magistrate. She also stated that she would be at the Delhi Cantonment police station along with the party lawyers.
Meanwhile, YouTuber and influencer Dhruv Rathee, who was taken into custody from his Gurugram residence just ahead of the protest, was released around 3 AM on Sunday.
What is preventive detention? What happens next?
Preventive detention is used to prevent a person from committing a crime or disturbing public peace. According to legal procedures, police can take individuals into custody to prevent a breach of peace.
Following their detention, the three CJP leaders were produced before a Special Executive Magistrate as part of the procedure. Section 126 of the BNSS requires submitting a bond to maintain peace, while Section 170 empowers the police to make advance arrests to prevent cognizable offenses.
When making an arrest without a warrant, an individual cannot be kept in custody for more than 24 hours without appropriate judicial authorization. Producing the person before a magistrate is a vital safeguard to prevent unnecessary detention.
Sections 126 and 170 in the current BNSS replace sections 107 and 151 of the old CrPC. Although Section 170 of the BNSS allows for arrests if it is believed that a situation cannot otherwise be prevented, the maximum detention time is 24 hours in the absence of other legal permissions.
CJP calls for a fresh march to Jantar Mantar
Despite the detention of senior leaders, the CJP called for a fresh protest march to Jantar Mantar at 10 AM on Sunday. The agitation against Gyanesh Kumar is being intensified over allegations of manipulation in the voter list.
Heavy security arrangements were deployed by the police across Delhi on Saturday to thwart the protest. Police had denied permission for the protest citing security concerns.
As part of measures to contain the protest, Delhi Police detained over 3,000 people across the capital on Saturday. More than 20,000 police personnel and central armed police were deployed in the capital, with around 6,500 personnel assigned solely around Jantar Mantar.
About 150 people were detained from Connaught Place alone. Additionally, as a preventive measure, the police detained over 600 individuals with past criminal backgrounds.
The security measures disrupted public transport in the capital. Several metro stations were closed and train services were suspended. Mobile internet services were temporarily halted within a 4-kilometer radius of the Janpath-Kartavya Path area. Strict checks were also implemented at the Delhi-Noida border. Metro station gates were opened and traffic was restored by Saturday night.
