കൊച്ചി: ചേരാനല്ലൂര്‍ വാഹനാപകടത്തില്‍ മരിച്ച ജയബാലകൃഷ്ണന്റെ കുടുംബത്തിന്റെ താത്പര്യപ്രകാരം സ്‌പെഷ്യല്‍ പബ്ലിക് പ്രോസിക്യൂട്ടറെ നിയമിക്കാമെന്ന് ആഭ്യന്തര മന്ത്രി രമേശ് ചെന്നിത്തല ഉറപ്പുനല്‍കി. തെക്കന്‍ ചിറ്റൂരിലെ ജയബാലകൃഷ്ണന്റെ വീട് സന്ദര്‍ശിച്ച ശേഷം മാധ്യമങ്ങളോട് സംസാരിക്കുകയായിരുന്നു അദ്ദേഹം.
കുടുംബം ആവശ്യപ്പെടുന്ന വ്യക്തിയെത്തന്നെ സ്‌പെഷ്യല്‍ പബ്ലിക് പ്രോസിക്യൂട്ടറായി നിയമിക്കുമെന്ന് ആഭ്യന്തരമന്ത്രി മകള്‍ ഭദ്രകീര്‍ത്തിക്ക് ഉറപ്പുനല്‍കി. സാധാരണ ഇത്തരം കേസുകളില്‍ കുടുംബത്തിന്റെ താത്പര്യമാണ് പരിഗണിക്കാറുള്ളതെന്നും ഇവിടെയും അതുതന്നെ നടപ്പാക്കുമെന്നും അദ്ദേഹം വ്യക്തമാക്കി.
കേസിന്റെ അന്വേഷണം കൃത്യമായ വഴിയിലൂടെ മുന്നോട്ട് പോകുമെന്നും പ്രോസിക്യൂഷന്റെ ഭാഗത്തുനിന്ന് ശക്തമായ നടപടികള്‍ ഉണ്ടാകുമെന്നും മന്ത്രി അറിയിച്ചു.
ജഡ്ജിയെയോ മറ്റാരെയെങ്കിലും രക്ഷിക്കാന്‍ ശ്രമിക്കില്ലെന്നും നീതിയും നിയമവും എല്ലാവര്‍ക്കും ഒരുപോലെയാണെന്നും അദ്ദേഹം വ്യക്തമാക്കി. സര്‍ക്കാരും മുഖ്യമന്ത്രിയും ആഭ്യന്തരമന്ത്രിയും നല്‍കിയ വാഗ്ദാനങ്ങളിലും ഉറപ്പുകളിലും പൂര്‍ണ്ണ വിശ്വാസമുണ്ടെന്നും അവസാനം വരെ സര്‍ക്കാര്‍ കൂടെയുണ്ടാകുമെന്ന് അറിയിച്ചിട്ടുണ്ടെന്നും ജയബാലകൃഷ്ണന്റെ മകള്‍ ഭദ്രകീര്‍ത്തി പ്രതികരിച്ചു.
മുഖ്യമന്ത്രിയും പ്രതിപക്ഷ നേതാവ് വി.ഡി. സതീശന്‍ ഉള്‍പ്പെടെയുള്ളവരും നേരത്തെ ജയബാലകൃഷ്ണന്റെ വീട് സന്ദര്‍ശിച്ചിരുന്നു. മദ്യപിച്ചും ലഹരി ഉപയോഗിച്ചും വാഹനമോടിച്ച് നിരപരാധികളുടെ ജീവന്‍ പൊലിയുന്ന സംഭവങ്ങളില്‍ കര്‍ശന നടപടി സ്വീകരിക്കുമെന്നും കേരളത്തില്‍ ഇത് അനുവദിക്കില്ലെന്നും ആഭ്യന്തരമന്ത്രി മുന്നറിയിപ്പ് നല്‍കി.
ഇതേസമയം, കേസില്‍ അന്വേഷണ ഉദ്യോഗസ്ഥനെതിരെ എറണാകുളം അഡിഷണല്‍ സെഷന്‍സ് കോടതിയുടെ രൂക്ഷ വിമര്‍ശനം. 17 കാരന്റെ ചിത്രങ്ങളും വിവരങ്ങളും സമൂഹമാധ്യമങ്ങളില്‍ പ്രചരിച്ച സംഭവത്തിലാണ് കോടതിയുടെ ഭാഗത്തുനിന്നു വിമര്‍ശനമുണ്ടായത്.
പ്രായപൂര്‍ത്തിയാകാത്ത കുട്ടിയുടെ ചിത്രങ്ങളും വ്യക്തിവിവരങ്ങളും സോഷ്യല്‍ മീഡിയയിലൂടെ പുറത്തുവന്നതില്‍ കോടതി അന്വേഷണ ഉദ്യോഗസ്ഥനോട് വിശദീകരണം തേടി. ഉദ്യോഗസ്ഥന്‍ നേരിട്ട് ഹാജരായി വിശദീകരണം നല്‍കാന്‍ കോടതി നിര്‍ദ്ദേശിച്ചിട്ടുണ്ട്.
മൈനറുടെ തിരിച്ചറിയല്‍ വിവരങ്ങള്‍ വെളിപ്പെടുത്തുന്ന തരത്തിലുള്ള എല്ലാ സമൂഹമാധ്യമ പോസ്റ്റുകളും ഉടന്‍ നീക്കം ചെയ്യാന്‍ സൈബര്‍ പൊലീസിന് കോടതി നിര്‍ദ്ദേശം നല്‍കി. ഇത് സംബന്ധിച്ച ആക്ഷന്‍ ടേക്കന്‍ണ്‍ റിപ്പോര്‍ട്ടും സമര്‍പ്പിക്കണം.
നരഹത്യാക്കുറ്റം ചുമത്തപ്പെട്ട കേസില്‍ ജുവനൈല്‍ ജസ്റ്റിസ് ബോര്‍ഡിന് ജാമ്യം നല്‍കാന്‍ അധികാരമില്ലെന്നായിരുന്നു പ്രോസിക്യൂഷന്റെ വാദം. പ്രസക്തമായ രേഖകള്‍ കൃത്യമായി പരിശോധിക്കാതെയാണ് ബോര്‍ഡ് ജാമ്യം അനുവദിച്ചതെന്നും പ്രോസിക്യൂഷന്‍ ആരോപിച്ചു. 17 കാരനെ ഒബ്‌സര്‍വേഷന്‍ ഹോമിലേക്ക് മാറ്റണമെന്നും പ്രോസിക്യൂഷന്‍ ആവശ്യപ്പെട്ടിട്ടുണ്ട്.
കഴിഞ്ഞ ഞായറാഴ്ച പുലര്‍ച്ചെ ചേരാനല്ലൂര്‍ മനയ്ക്കക്കടവ് അമ്പലത്തിന് സമീപത്തുവച്ചാണ് സംഭവം. മാഞ്ഞാലി സ്വദേശി ജയബാലകൃഷ്ണന്‍ (55) സഞ്ചരിച്ചിരുന്ന സ്‌കൂട്ടറിലിടിച്ചാണ് അപകടമുണ്ടായത്. സംഭവസ്ഥലത്തുതന്നെ ജയബാലകൃഷ്ണന്‍ മരിച്ചു. കാര്‍ ഓടിച്ചിരുന്നത് അഡിഷണല്‍ ജില്ലാ ജഡ്ജിയുടെ 17 കാരനായ മകനായിരുന്നു.
യൂട്യൂബ് നോക്കിയാണ് താന്‍ ഡ്രൈവിംഗ് പഠിച്ചതെന്നാണ് കുട്ടി മൊഴി നല്‍കിയിരുന്നതെങ്കിലും, ഇന്‍സ്റ്റാഗ്രാം അടക്കമുള്ള സമൂഹമാധ്യമങ്ങളില്‍ കുട്ടി അതിവേഗത്തില്‍ കാര്‍ ഓടിക്കുന്നതിന്റെ ദൃശ്യങ്ങള്‍ പ്രചരിച്ചിരുന്നുവെന്ന് അന്വേഷണ സംഘം കണ്ടെത്തിയിരുന്നു. കേസില്‍ വാഹന ഉടമയായ ജഡ്ജിയെയും പ്രതിചേര്‍ത്തിട്ടുണ്ട്.
ജയബാലകൃഷ്ണന്റെ കുടുംബത്തെ സന്ദര്‍ശിച്ച് പ്രതിപക്ഷനേതാവ് പിണറായി വിജയന്‍. അതീവദുഃഖകരമായ സംഭവമാണിത്. ആദ്യഘട്ടം മുതല്‍ കേസില്‍ കുടുംബത്തിന് അതൃപ്തി ഉണ്ട്. നീതിലഭിക്കുന്നില്ലെന്ന തോന്നല്‍ കുടുംബത്തിന് ആദ്യം മുതല്‍ക്കേ ഉണ്ടായി. അതിന്റെ ഭാഗമായുള്ള ചില പ്രത്യക്ഷ നടപടികള്‍ ജയബാലകൃഷ്ണന്റെ ചിത എരിയുന്നതിന് മുന്‍പ് തന്നെ കുടുംബത്തിന് സ്വീകരിക്കേണ്ടതായി വന്നു.
ഇക്കാര്യം സഭയില്‍ ഉന്നയിച്ചപ്പോള്‍ സര്‍ക്കാരിന്റെ ഭാഗത്ത് നിന്ന് കൃത്യമായി പ്രതികരണം ഉണ്ടായി. അത് കുറ്റവാളിക്കെതിരെ ശക്തമായ നടപടി സ്വീകരിക്കും, അര്‍ഹമായ ശിക്ഷ ഉറപ്പാക്കും, ഒരു വീഴ്ചയും ഉണ്ടാകില്ലെന്ന് ആദ്യമേ തന്നെ ഉറപ്പായി സഭയില്‍ രേഖപ്പെടുത്തിയിരുന്നു.
പിന്നീട് നടപടികള്‍ ആ തരത്തില്‍ അല്ല ഉണ്ടായതെന്നാണ് കുടുംബം പറയുന്നത്. കടുത്ത മനോവേദനയോടെ കഴിയുന്ന ഈ കുടുംബം മുഖ്യമന്ത്രിയും ആഭ്യന്തരമന്ത്രിയും നേരില്‍ കണ്ടെങ്കിലും നടപടിക്രമങ്ങള്‍ വേണ്ടത്ര ജാഗ്രതയോടെ നീങ്ങുന്നില്ലെന്ന തോന്നലിലാണ് നില്‍ക്കുന്നതെന്ന് പിണറായി വിജയന്‍ പ്രതികരിച്ചു.

Kochi: Home Minister Ramesh Chennithala has assured that a Special Public Prosecutor will be appointed as per the wishes of the family of Jayabalakrishnan, who died in the Cheranalloor road accident. He was speaking to the media after visiting Jayabalakrishnan's house in Thekkan Chittoor.
The Home Minister assured the victim's daughter, Bhadrakeerthi, that the person requested by the family will be appointed as the Special Public Prosecutor. He stated that normally the family's preference is considered in such cases, and the same will be implemented here as well.
The minister informed that the investigation into the case will move forward in the right direction and strong steps will be taken from the side of the prosecution. He clarified that no attempt will be made to protect the judge or anyone else, and that justice and law are equal for everyone. Bhadrakeerthi responded that the family has full faith in the promises and assurances given by the government, the Chief Minister, and the Home Minister, and that they have been informed the government will stand with them until the end.
Chief Minister and Opposition Leader V.D. Satheesan, among others, had earlier visited Jayabalakrishnan's house. The Home Minister warned that strict action will be taken against incidents where lives of innocent people are lost due to drunk driving and substance abuse, and that this will not be allowed in Kerala.
Meanwhile, the Ernakulam Additional Sessions Court came down heavily on the investigating officer in the case. The court's criticism came over the incident where the photos and details of the 17-year-old were circulated on social media.
The court sought an explanation from the investigating officer regarding the leak of the minor's identity and personal details via social media. The court has directed the officer to appear in person and provide an explanation.
The cyber police have been instructed by the court to immediately remove all social media posts revealing the minor's identification details. An action taken report in this regard must also be submitted.
The prosecution argued that the Juvenile Justice Board does not have the power to grant bail in a case where a culpable homicide charge has been invoked. The prosecution alleged that the Board granted bail without properly examining the relevant documents. The prosecution has also demanded that the 17-year-old be shifted to an observation home.
The incident took place last Sunday early morning near the Manakkakkadavu temple in Cheranalloor. The accident occurred when a car rammed into the scooter ridden by Jayabalakrishnan (55), a native of Manjali. Jayabalakrishnan died on the spot. The car was driven by the 17-year-old son of an Additional District Judge.
Although the boy had given a statement that he learned driving by watching YouTube, the investigation team found that videos of the boy driving cars at high speeds were circulated on social media platforms including Instagram. The judge, who is the owner of the vehicle, has also been named as an accused in the case.
Opposition Leader Pinarayi Vijayan visited Jayabalakrishnan's family. "This is an extremely tragic incident. The family has been dissatisfied with the case from the very beginning. The family felt from the outset that they were not getting justice. As a result of this, certain visible steps had to be taken by the family even before the funeral pyre of Jayabalakrishnan was extinguished. When this matter was raised in the assembly, there was a clear response from the government.
It was assured in the assembly right at the beginning that strong action will be taken against the culprit, deserving punishment will be ensured, and there will be no lapses. However, the family says that subsequent actions did not proceed in that manner. Pinarayi Vijayan reacted that this family, living in severe mental agony, feels that even though the Chief Minister and the Home Minister met them in person, the procedural steps are not moving forward with enough caution.
