News in English: The High Court has stayed the arrest of an Additional Sessions Judge, who is the father of a 17-year-old accused of ramming a car into a scooter rider and killing him at Cheranalloor. The court questioned the necessity of arresting the judge, noting that he is fully cooperating with the police investigation and questioning. Considering the judge's anticipatory bail plea, the court granted a temporary stay on his arrest.
Justice Kauser Edappagath raised the question while hearing the judge's bail application. Justice Kauser observed that the applicant is a serving judicial officer and is unlikely to abscond or evade legal proceedings. Following this, the court ordered that the judge should not be arrested until further orders.
"Why was it necessary to interrogate him for four hours? What is the need to question him again now? Why is his arrest required? He is a judicial officer, and he will cooperate with the investigation," the court clarified.
However, the court directed the judge to appear before the investigating officer at 1:00 PM and to present himself again if required. The court also reminded the police that any interrogation of the applicant must strictly adhere to the guidelines prescribed by the Supreme Court.
Meanwhile, the family of Jayabalakrishnan (the deceased) opposed the judge's anticipatory bail application, stating that justice has not been served. The family alleged that the judge is attempting to evade the case, which is why the matter has reached the High Court. They pointed out that as a gazetted officer or above, he approached the High Court directly. A relative of Jayabalakrishnan told the media that the judge is employing every tactic to slip out of the case and that they have been denied justice.
