തിരുവനന്തപുരം: 2006-ലെ എം.സി. റോഡ്-കെ.എസ്.ടി.പി അഴിമതിയും മലേഷ്യന് എഞ്ചിനീയറുടെ ആത്മഹത്യയുമായി ബന്ധപ്പെട്ട് ഇപ്പോഴത്തെ മുഖ്യ തിരഞ്ഞെടുപ്പ് കമ്മിഷണര് ഗ്യാനേഷ് കുമാറിനെതിരെ മുന് ധനമന്ത്രിയും സി.പി.എം നേതാവുമായ ടി.എം. തോമസ് ഐസക് ഉന്നയിച്ച ആരോപണങ്ങള് വലിയ ചര്ച്ചയായി മാറുന്നു.
2006-ല് വി.എസ്. അച്യുതാനന്ദന് സര്ക്കാരിന്റെ കാലത്ത് പൊതുമരാമത്ത് വകുപ്പ് സെക്രട്ടറിയായിരിക്കെ, ഗ്യാനേഷ് കുമാറിനെതിരെ ഉയര്ന്ന കൈക്കൂലി ആരോപണങ്ങളും വിജിലന്സ് അന്വേഷണവും ഫേസ്ബുക്ക് പോസ്റ്റിലൂടെയാണ് തോമസ് ഐസക് വീണ്ടും സജീവ ചര്ച്ചയാക്കിയിരിക്കുന്നത്.
ലോകബാങ്ക് ധനസഹായത്തോടെ നടപ്പാക്കിയ കേരള സ്റ്റേറ്റ് ട്രാന്സ്പോര്ട്ട് പ്രൊജക്റ്റിന്റെ ഭാഗമായഎം സി റോഡ് വികസനത്തിന്റെ കരാര് മലേഷ്യന് കമ്പനിയായ 'പതി'യും പ്രാദേശിക പങ്കാളിയായ ഭഗീരഥ കണ്സ്ട്രക്ഷന്സും ചേര്ന്നു രൂപീകരിച്ച പതിബെല് എന്ന കമ്പനിക്കാണ് നല്കിയിരുന്നത്. 216 കോടി രൂപയുടെ കരാറായിരുന്നു ഇത്.
റോഡ് നിര്മ്മാണത്തിന് ആവശ്യമായ സ്ഥലം സമയബന്ധിതമായി വിട്ടുനല്കാന് പി.ഡബ്ല്യു.ഡി പരാജയപ്പെട്ടു എന്ന് കമ്പനി ആരോപിച്ചിരുന്നു. കൈമാറിയ സ്ഥലങ്ങളില് പോലും പ്രവൃത്തികള് കൃത്യമായി നടന്നില്ല എന്ന് ആരോപിച്ചു കൊണ്ട് കമ്പനിയുടെ ബില്ലുകള് പൊതുമരാമത്ത് വകുപ്പ് തടഞ്ഞുവച്ചു.
ഈ വിവാദങ്ങള്ക്കിടയില്, പതിബെല് കമ്പനിയുടെ കേരളത്തിലെ പ്രൊജക്റ്റ് ഓഫീസറായിരുന്ന മലേഷ്യന് എഞ്ചിനീയര് ലീ ബിന് സീന് 2006 നവംബറില് മലേഷ്യയിലെ ക്വാലാലംപൂരിലെ വീട്ടില് വച്ച് ആത്മഹത്യ ചെയ്തു. തന്റെ സ്വത്തുക്കള് വിറ്റ് ജീവനക്കാര്ക്ക് ശമ്പളം നല്കാന് വേണ്ട ഇടപാടെല്ലാം ചെയ്ത ശേഷമായിരുന്നു ലീ ബിന് സീന് ആത്മഹത്യ ചെയ്തത്.
അദ്ദേഹം എഴുതിവച്ച ആത്മഹത്യാ കുറിപ്പില്, കേരളത്തിലെ പൊതുമരാമത്ത് വകുപ്പിലെ ഉദ്യോഗസ്ഥരില് നിന്നു കടുത്ത മാനസിക പീഡനവും അഴിമതിയും നേരിടേണ്ടി വന്നതായി വ്യക്തമാക്കിയിരുന്നു. അന്ന് പി.ഡബ്ല്യു.ഡി സെക്രട്ടറിയായിരുന്ന ഗ്യാനേഷ് കുമാര് ഉള്പ്പെടെയുള്ള ഉദ്യോഗസ്ഥര് കൈക്കൂലി ആവശ്യപ്പെട്ടുവെന്നും ബില്ലുകള് മാറുന്നതിന് തടസ്സം നിന്നുവെന്നും ആത്മഹത്യാ കുറിപ്പില് ചൂണ്ടിക്കാണിച്ചിരുന്നതായി തോമസ് ഐസക് ആരോപിക്കുന്നു.
ഈ സംഭവം വലിയ വിവാദമായതിനെ തുടര്ന്ന് വി.എസ്. അച്യുതാനന്ദന് സര്ക്കാര് ഗ്യാനേഷ് കുമാറിനെ പി.ഡബ്ല്യു.ഡി സെക്രട്ടറി സ്ഥാനത്തുനിന്ന് അടിയന്തരമായി മാറ്റി നിര്ത്തുകയും കേസില് വിജിലന്സ് അന്വേഷണത്തിന് ഉത്തരവിടുകയും ചെയ്തു. പിന്നീട് ഗ്യാനേഷ് കുമാര് കേന്ദ്ര ഡെപ്യൂട്ടേഷനില് പ്രതിരോധ മന്ത്രാലയത്തിലേക്ക് മാറുകയായിരുന്നു. അധികാരപരിധിയുടെ പ്രശ്നങ്ങളും ഉദ്യോഗസ്ഥരുടെ താത്പര്യക്കുറവും കാരണം വിജിലന്സ് അന്വേഷണം എങ്ങുമെത്താതെ അവസാനിക്കുകയും ചെയ്തു.
കരാര് തര്ക്കങ്ങള് മൂലം 2007-ല് സര്ക്കാരിന് 35 കോടി രൂപ നഷ്ടപരിഹാരമായി കമ്പനിക്ക് നല്കേണ്ടിവന്നു. 216 കോടി രൂപ പ്രതീക്ഷിച്ച പദ്ധതി പൂര്ത്തിയായപ്പോള് ഏകദേശം 330 കോടിയിലധികം രൂപയായി വര്ദ്ധിച്ചു.
അന്ന് അഴിമതി ആരോപണത്തില് പെട്ട ഉദ്യോഗസ്ഥന് പിന്നീട് കേന്ദ്രത്തില് ഉന്നത പദവികളില് എത്തുകയും നിലവില് ചീഫ് ഇലക്ഷന് കമ്മിഷണറായി നിയമിക്കപ്പെടുകയും ചെയ്ത നടപടിയെ തോമസ് ഐസക് ചോദ്യം ചെയ്യുന്നു. ഗ്യാനേഷ് കുമാറിനെ ചീഫ് ഇലക്ഷന് കമ്മിഷണര് സ്ഥാനത്തുനിന്ന് നീക്കം ചെയ്യണമെന്നും അദ്ദേഹത്തിനെതിരെ പാര്ലമെന്റില് ഇംപീച്ച്മെന്റ് നടപടികള് വരണമെന്നും തോമസ് ഐസക് ആവശ്യപ്പെട്ടു.
ഇതേസമയം, ഗ്യാനേഷ് കുമാര് ബി.ജെ.പി ഏജന്റായി പ്രവര്ത്തിച്ചു എന്നതിന് ഇനി കൂടുതല് തെളിവുകള് ആവശ്യമില്ലെന്ന് മുഖ്യമന്ത്രി വി.ഡി. സതീശന്. ജനാധിപത്യത്തെ ബി.ജെ.പിക്ക് വേണ്ടി അട്ടിമറിക്കുന്ന ഏജന്റായിരുന്നു ഗ്യാനേഷ് കുമാര് എന്ന് തെളിഞ്ഞതായി അദ്ദേഹം സോഷ്യല് മീഡിയയില് കുറിച്ചു.
'തിരഞ്ഞെടുപ്പ് കമ്മിഷന്റെ വിശ്വാസ്യതയെ ബി.ജെ.പിക്ക് കച്ചവടം നടത്തിയ ഗ്യാനേഷ് കുമാറിനെ, ഇന്ത്യന് ജനാധിപത്യത്തിന് വധശിക്ഷ വിധിച്ചയാളെന്ന് ചരിത്രം രേഖപ്പെടുത്തും. രാജ്യത്തെ ഏറ്റവും ഉയര്ന്ന ഭരണഘടനാ പദവിയിലൊന്നിരുന്നുകൊണ്ട് ജനാധിപത്യത്തെ അട്ടിമറിച്ച ഗ്യാനേഷ് കുമാര് ഒരു നിമിഷം പോലും ആ സ്ഥാനത്ത് തുടരരുത്.'
തിരഞ്ഞെടുപ്പ് പ്രക്രിയയുടെ ശുദ്ധിയെപ്പറ്റി ഭരണഘടന തന്നെ വ്യക്തമായി ചൂണ്ടിക്കാണിക്കുന്നുണ്ട്. അങ്ങേയറ്റം സ്വതന്ത്രമായി പ്രവര്ത്തിക്കേണ്ട തിരഞ്ഞെടുപ്പ് കമ്മിഷനെ സംഘപരിവാറിന്റെ തൊഴുത്തില് കെട്ടിയ ക്രിമിനല് ബുദ്ധിയുള്ള ഉദ്യോഗസ്ഥനാണ് ഗ്യാനേഷ് കുമാറെന്നും, അദ്ദേഹം ഈ സ്ഥാനത്ത് തുടരുന്നത് ഇന്ത്യന് ജനാധിപത്യത്തെ അങ്ങേയറ്റം അപകടത്തിലാക്കുമെന്നും സതീശന് ആരോപിച്ചു.
തിരഞ്ഞെടുപ്പ് കമ്മിഷന്റെ സുതാര്യത, സത്യസന്ധത, നിഷ്പക്ഷത, ഉയര്ന്ന ജനാധിപത്യ ബോധം എന്നിവയെല്ലാം ഗ്യാനേഷ് കുമാര് അട്ടിമറിച്ചു. ലോക്സഭാ പ്രതിപക്ഷ നേതാവ് രാഹുല് ഗാന്ധി നേരത്തെ ഉന്നയിച്ച ആരോപണങ്ങളെല്ലാം ഇപ്പോള് സത്യമാണെന്ന് തെളിഞ്ഞിരിക്കുകയാണ്. ബി.ജെ.പിയുമായി പരസ്പര സഹകരണത്തില് പ്രവര്ത്തിക്കുന്ന സ്ഥാപനമാക്കി തിരഞ്ഞെടുപ്പ് കമ്മിഷനെ അധഃപതിപ്പിച്ച ഗ്യാനേഷ് കുമാര് ഇനിയും സ്ഥാനത്ത് തുടരുന്നത് ഇന്ത്യന് ജനാധിപത്യത്തെ കൂടുതല് കളങ്കപ്പെടുത്തുമെന്നും വി.ഡി. സതീശന് കൂട്ടിച്ചേര്ത്തു.

Allegations raised by former Finance Minister and CPI(M) leader T.M. Thomas Isaac against current Chief Election Commissioner Gyanesh Kumar, linking him to the 2006 MC Road-KSTP corruption case and the suicide of a Malaysian engineer, have triggered widespread debate.
Through a Facebook post, Thomas Isaac has reignited discussions surrounding bribery allegations and a Vigilance investigation against Gyanesh Kumar during his tenure as Public Works Department (PWD) Secretary under the V.S. Achuthanandan government in 2006.
The contract for the MC Road development—part of the World Bank-assisted Kerala State Transport Project (KSTP)—was awarded to Patibel, a joint venture between the Malaysian company 'Pati' and local partner Bhageeratha Constructions. The project was valued at ₹216 crore.
The company alleged that the PWD failed to hand over the required land on time. Conversely, the PWD withheld the company's bills, claiming that work was not carried out properly even on the land provided.
Amid these controversies, Lee Bean Sene, a Malaysian engineer and project officer for Patibel in Kerala, died by suicide at his home in Kuala Lumpur, Malaysia, in November 2006. Before taking his life, he had arranged to sell his personal assets to pay his employees' salaries.
Thomas Isaac alleges that Lee Bean Sene left behind a suicide note stating he faced severe mental harassment and corruption from officials in Kerala's PWD. The suicide note reportedly pointed out that officials, including then-PWD Secretary Gyanesh Kumar, demanded bribes and blocked the clearance of bills.
Following a major public outcry, the V.S. Achuthanandan government immediately removed Gyanesh Kumar from the post of PWD Secretary and ordered a Vigilance probe. Later, Gyanesh Kumar moved to central deputation in the Ministry of Defence. Owing to jurisdictional issues and official apathy, the Vigilance probe eventually reached a dead end without conclusive action.
Due to contractual disputes, the government was forced to pay ₹35 crore in compensation to the company in 2007. A project originally estimated at ₹216 crore eventually escalated to over ₹330 crore upon completion.
Thomas Isaac questioned how an official embroiled in bribery allegations could subsequently rise to top administrative positions at the Centre and eventually be appointed Chief Election Commissioner. He demanded that Gyanesh Kumar be removed from the position of Chief Election Commissioner and that impeachment proceedings be initiated against him in Parliament.
Meanwhile, Leader of the Opposition V.D. Satheesan stated that no further proof is needed to show Gyanesh Kumar functioned as an agent of the BJP. In a social media post, Satheesan remarked that Gyanesh Kumar has been exposed as an agent working to subvert democracy for the BJP.
"History will record Gyanesh Kumar, who traded the Election Commission's credibility to the BJP, as the man who passed a death sentence on Indian democracy. Sitting in one of the highest constitutional offices in the country, Gyanesh Kumar, who subverted democracy, should not remain in that post even for a second."
Satheesan alleged that while the Constitution clearly emphasizes the purity of the electoral process, Gyanesh Kumar—acting with a criminal mindset—tied an independent body like the Election Commission to the Sangh Parivar's stable, placing Indian democracy at extreme risk.
He added that Gyanesh Kumar dismantled the Election Commission's transparency, integrity, impartiality, and high democratic principles, proving former Lok Sabha Leader of the Opposition Rahul Gandhi's previous allegations true. Satheesan further noted that continuing to hold office while reducing the Election Commission to an entity acting in collusion with the BJP will only degrade Indian democracy further.
