Vehicle Modifications to Attract ₹5,000 Fine per Alteration; YouTubers Also Face Action: High Court Issues Strict Directions

തിരുവനന്തപുരം: വാഹനങ്ങളില് അനധികൃത രൂപമാറ്റത്തിന്, ഓരോ മാറ്റത്തിനും 5,000 രൂപ വീതം പിഴ ഈടാക്കാന് ഹൈക്കോടതി നിര്ദ്ദേശിച്ചു. യുവാക്കളുടെ ഇഷ്ടപ്രകാരം വാഹനങ്ങളില് മോഡിഫിക്കേഷന് അനുമതി നല്കുമെന്നു മുഖ്യമന്ത്രി വിഡി സതീശന് പറഞ്ഞിരുന്നു.
ഇതിനു പിന്നാലെയാണ് ജസ്റ്റിസ് അനില് കെ. നരേന്ദ്രന്, ജസ്റ്റിസ് മുരളി കൃഷ്ണ എസ്. എന്നിവരടങ്ങുന്ന ഡിവിഷന് ബെഞ്ച് പിഴയ്ക്കു നിര്ദ്ദേശിച്ചത്.
മുന്പ് ഒരു വാഹനത്തില് എത്ര മോഡിഫിക്കേഷനുകള് ഉണ്ടായാലും ആകെ 5,000 രൂപ പിഴയാണ് ചുമത്തിയിരുന്നത്. ഉദാഹരണത്തിന്, ആറ് അനധികൃത ലൈറ്റുകള് വെച്ച താര് വാഹനത്തിന് ആകെ 5,000 രൂപ മാത്രം പിഴ ഈടാക്കിയതില് കോടതി കടുത്ത അമര്ഷം രേഖപ്പെടുത്തി.
പുതിയ ഉത്തരവനുസരിച്ച് ആറു മാറ്റങ്ങള് വരുത്തിയിട്ടുണ്ടെങ്കില് 30,000 രൂപ പിഴ നല്കേണ്ടി വരും. മോട്ടോര് വാഹന നിയമം അനുസരിച്ച് കമ്പനി നിര്മ്മിച്ച രൂപകല്പ്പനയില് മാറ്റം വരുത്തുന്നത് നിയമവിരുദ്ധമാണ്.
അമിത വെളിച്ചമുള്ള എല് ഇ ഡി ലൈറ്റ് ബാറുകള്, കളര് ബുള്ബുകള്, മള്ട്ടി-കളര് എല് ഇ ഡി, സ്ട്രോബ് ലൈറ്റുകള്, ഫ്ലാഷ് ലൈറ്റുകള്, നിയോണ് ബോര്ഡുകള്, വലിയ ശബ്ദമുണ്ടാക്കുന്ന സൈലന്സറുകള്, എക്സോസ്റ്റില് നിന്ന് തീയും പുകയും വരുന്ന ഫ്ളെയിം കിറ്റ്, ബോഡിക്കു പുറത്തേക്ക് നില്ക്കുന്ന അമിത വീതിയുള്ള ടയറുകള്, വീല് സ്പേസറുകള്, വാഹനത്തിന്റെ ബോഡി ഫ്രെയിമിലോ കളറിലോ ഘടനയിലോ വരുത്തുന്ന അനധികൃത മാറ്റങ്ങള് എന്നിവയെല്ലാം പിഴയ്ക്കു കാരണമാവും.
നിയമവിരുദ്ധമായി മോഡിഫൈ ചെയ്ത കാറുകളും ബൈക്കുകളും ഉപയോഗിച്ച് യൂട്യൂബ്, ഇന്സ്റ്റാഗ്രാം റീലുകള് പകര്ത്തി പ്രോത്സാഹിപ്പിക്കുന്ന സോഷ്യല് മീഡിയ ഇന്ഫ്ലുവന്സര്മാര്ക്കെതിരെയും കര്ശന നടപടിയെടുക്കാന് കോടതി നിര്ദ്ദേശിച്ചിട്ടുണ്ട്.
പിഴ അടച്ചതുകൊണ്ട് മാത്രം കാര്യമില്ല. വാഹനത്തിലെ അനധികൃത ഭാഗങ്ങള് മാറ്റിയ ശേഷം വാഹനം ആര്.ടി.ഒ ഓഫീസില് ഹാജരാക്കി പുനഃപരിശോധന നടത്തി അനുമതി വാങ്ങണം. മുന്കാലങ്ങളില് നടത്തിയ പരിശോധനകളുടെയും ഇന്ഫ്ലുവന്സര്മാര്ക്കെതിരെ എടുത്ത നടപടികളുടെയും റിപ്പോര്ട്ട് സെപ്റ്റംബര് 3-നകം സമര്പ്പിക്കാന് ട്രാന്സ്പോര്ട്ട് കമ്മിഷണറേറ്റ് കോടതി ആവശ്യപ്പെട്ടിട്ടുണ്ട്. കൂടാതെ, കേന്ദ്ര മോട്ടോര് വാഹന നിയമങ്ങള് അനുസരിച്ച് നിര്മ്മാതാക്കള് നല്കിയിട്ടില്ലാത്ത സുരക്ഷാ മാനദണ്ഡങ്ങള്ക്ക് വിരുദ്ധമായ ലൈറ്റുകളോ ഭാഗങ്ങളോ ഉപയോഗിക്കാന് പാടില്ലെന്ന് ഹൈക്കോടതി ആവര്ത്തിച്ചു വ്യക്തമാക്കി.

The High Court has directed authorities to collect a fine of ₹5,000 for each unauthorized alteration made to vehicles. The direction from the Division Bench—comprising Justice Anil K. Narendran and Justice Murali Krishna S.—came shortly after Chief Minister VD Satheesan stated that vehicle modifications desired by the youth would be permitted.
Previously, a total fine of only ₹5,000 was levied regardless of the number of modifications on a vehicle. The court expressed strong displeasure over an instance where a Thar vehicle fitted with six unauthorized lights was fined just ₹5,000 in total. Under the new order, if six alterations have been made, a fine of ₹30,000 will have to be paid. Under the Motor Vehicles Act, altering the manufacturer's original design is illegal.
Key Reasons for Fines
High-intensity LED light bars, color bulbs, multi-color LEDs, strobe lights, flashlights, and neon boards
Loud exhausts/silencers and flame kits that emit fire and smoke from the exhaust
Oversized tires protruding outside the vehicle body, along with wheel spacers
Unauthorized changes to the vehicle’s body frame, color, or structural parameters
The court has also instructed strict action against social media influencers who promote illegally modified cars and bikes through YouTube videos and Instagram reels.
Paying the fine alone will not suffice. Owners must revert the vehicle to its original condition by removing the illegal parts, present the vehicle at the RTO office, and obtain re-inspection clearance. The court has directed the Transport Commissionerate to submit a report by September 3 regarding past inspections and actions taken against influencers. Furthermore, the High Court reiterated that lights or components violating safety standards not provided by the manufacturer under the Central Motor Vehicles Rules must not be used.
