തിരുവനന്തപുരം: രാഹുല് മാങ്കൂട്ടത്തില് എം.എല്.എ. പ്രതിയായ ലൈംഗിക പീഡനക്കേസിലെ യുവതിയെ സാമൂഹിക മാധ്യമങ്ങളിലൂടെ അധിക്ഷേപിച്ചതിന് അദ്ദേഹത്തിന്റെ വിശ്വസ്തനും യൂത്ത് കോണ്ഗ്രസ് നേതാവുമായ ഫെനി നൈനാനെതിരെ സൈബര് പോലീസ് കേസെടുത്തു. പ്രത്യേക അന്വേഷണ സംഘം നല്കിയ ശുപാര്ശയുടെ അടിസ്ഥാനത്തിലാണ് കേസെടുത്തത്.
രാഹുല് മാങ്കൂട്ടത്തിലിനെതിരെയുള്ള മൂന്നാമത്തെ പീഡന പരാതി ഉന്നയിച്ച യുവതിയുടെ സ്വകാര്യ വാട്സ്ആപ്പ് ചാറ്റുകള് ഫെനി നൈനാന് ഫേസ്ബുക്കിലൂടെ പുറത്തുവിട്ടിരുന്നു. യുവതിയും രാഹുല് മാങ്കൂട്ടത്തിലും തമ്മിലുള്ള സ്വകാര്യ വാട്സ്ആപ്പ് ചാറ്റുകളുടെ സ്ക്രീന്ഷോട്ടുകളാണ് ഫെനി നൈനാന് ഫേസ്ബുക്കിലൂടെ പരസ്യപ്പെടുത്തിയത്. രാഹുലിനെ ന്യായീകരിക്കുന്നതിനും പരാതിക്കാരിയെ മോശമായി ചിത്രീകരിക്കുന്നതിനുമാണ് ഇത് ചെയ്തതെന്ന പരാതിയിലാണ് പോലീസ് നടപടി.
യുവതിയുടെ സ്വകാര്യത ലംഘിച്ചും അവരെ സൈബര് ആക്രമണത്തിന് ഇരയാക്കിയും അധിക്ഷേപിച്ചു എന്നതാണ് ഫെനിക്കെതിരെയുള്ള പ്രധാന കുറ്റം. പാലക്കാട് ഉപതിരഞ്ഞെടുപ്പ് സമയത്ത് പണമില്ലെന്ന് പറഞ്ഞ് യുവതിയില് നിന്ന് ഫെനി പണം വാങ്ങിയതായും യുവതിയെ രാഹുലിന്റെ അടുത്തേക്ക് എത്തിക്കാന് വാഹനമോടിച്ചത് ഫെനിയാണെന്നും അതിജീവിതയുടെ പരാതിയില് നേരത്തെ പരാമര്ശമുണ്ടായിരുന്നു.
രാഹുല് മാങ്കൂട്ടത്തില് നിലവില് ഈ കേസുമായി ബന്ധപ്പെട്ട് മാവേലിക്കര സ്പെഷ്യല് സബ് ജയിലില് റിമാന്ഡിലാണ്. ഈ പശ്ചാത്തലത്തില് ഫെനി നൈനാന് നടത്തിയ പ്രതികരണങ്ങളാണ് ഇപ്പോള് പുതിയ നിയമനടപടികള്ക്ക് കാരണമായിരിക്കുന്നത്.
പരാതിക്കാരിയുടെ ഐഡന്റിറ്റി വെളിപ്പെടുത്തുന്ന തരത്തിലും അവരെ സൈബര് ആക്രമണത്തിന് വിട്ടുകൊടുക്കുന്ന തരത്തിലുമാണ് ഫെനിയുടെ പ്രതികരണമെന്ന് പരാതിയില് പറയുന്നു.
കേസെടുത്തതിനോട് പ്രതികരിച്ച ഫെനി, താന് ഉന്നയിച്ച ചോദ്യങ്ങള് ഇപ്പോഴും പ്രസക്തമാണെന്ന് ഫേസ്ബുക്കിലൂടെ വ്യക്തമാക്കി. 'ചാറ്റ് പുറത്തുവിട്ടതിനാണ് കേസെങ്കില് ഇതേ ചാറ്റുകള് വാര്ത്തയാക്കിയ മാധ്യമങ്ങള്ക്കെതിരെ എന്തുകൊണ്ട് കേസെടുക്കുന്നില്ല?' എന്ന് അദ്ദേഹം ചോദിച്ചു.
രണ്ടാമത്തെ മാനഭംഗ പരാതിയില് രാഹുലിനെ ഹോംസ്റ്റേയില് എത്തിക്കാന് കാറോടിച്ചത് താനാണെന്ന് പരാതിക്കാരി പറഞ്ഞിട്ടും എന്തുകൊണ്ട് തനിക്കെതിരേ കേസെടുത്തില്ലെന്നും നടക്കുന്നത് രാഷ്ട്രീയ പകപോക്കലാണെന്നും ഫെനി പറഞ്ഞിരുന്നു. രാഹുലിന്റെ ജാമ്യാപേക്ഷ നാളെ (ജനുവരി 16) തിരുവല്ല കോടതി പരിഗണിക്കും.

These chats pertained to the woman who filed the third molestation complaint against Rahul. The police action follows a complaint stating that this was done to justify Rahul and portray the complainant in a negative light.
The primary charges against Feni include violating the survivor’s privacy, subjecting her to cyberattacks, and insulting her. The survivor’s earlier complaint also mentioned that Feni had taken money from her during the Palakkad by-election claiming he was broke, and that it was Feni who drove the vehicle to take her to Rahul.
Rahul Mamkootathil is currently remanded at the Mavelikara Special Sub-Jail in connection with this case. The recent comments and actions by Feni Nainaan in this context have now led to these new legal proceedings. The complaint further states that Feni's reactions were intended to reveal the identity of the victim and expose her to cyber harassment.
Responding to the case, Feni stated via Facebook that the questions he raised remain relevant. "If the case is for leaking the chats, why are cases not being registered against the media outlets that reported the same chats?" he asked. He also claimed that despite the complainant stating he drove the car to the homestay in the second rape complaint, no case was filed against him then, alleging that the current move is "political vendetta."
The Thiruvalla court is scheduled to consider Rahul’s bail application tomorrow (January 16).
